    Hi Guys...Update!

    So 7th Dec I got letter from Mackenzie Hall, returning postal order and saying they have requested info from client and if dont receive a response with x days they will close my file and return it to creditor, in meantime they wont chase payment.

    Now ive received another letter from them saying 'please find attached statement of account or copy of agreement as requested (they attached a statement). Payment must be received by our offices within 7 days' Evidently the right hand doesnt know what the left hand is doing

    Shall i just ignore this for now?

    I thought that Garlok, looks very much like a proper assignment to me. Well so far only RBS have come up with the goods and thats unenforceable, Cabot .. well they dont need to provide but im gonna play the slow game with them!

    Thanks Mrs D. The letter of assignment is exactly that and Arrow have inherited all of the liabilities and obligations under the Act, not just the profitable bits. Ads they own the debt they are responsible under the Act to provide and furnish properly the s78 request.

    Mind I do note an awful lot of debt purchasers are trying this on of late. I think many of them realise they have bought UE accounts that they cannot enforce. Just batter them back like they try to batter you.

    Hi all, ok back on 16th September I received a letter from Phoenix recoveries with regard the littlewoods debt headed Notice of Assignment and saying:

    We advise you that Phoenix Recoveries has assigned all of its respective rights, title and interest in respect of this account (including the right to receive payment of the outstanding balance) to Arrow Global Ltd effective from 13th May 2010. Any payments made on this account after 31st December 2010 will be passed to ARrow Global and will be deducted from the balance. It is essential that all future payments and correspondence regarding this account be directed to Buchanan Clark and Wells.

    So, I was paying BCW until I found this site. I sent the first postal order and CCA request to BCW who returned it and told me to send it to Arrow Global which I did. I have now received this letter from Arrow Global:

    We do not accept that we are the creditor as envisaged by the above statute (refering to the cca i presume). However we are willing to assist in obtaining that which as been requested. We will process your request for documentation from the creditor and will revert in due course. We confirm that all collection activity will be suspended pending provision of the documents.

    I find this a bit bizarre as surely they are the creditors as per the assignment??


    As for the other debts.. update below.

    Mackenzie hall -have returned the p/o saying they have requested cca from capquest.

    CL Finance (big loan) - heard nothing since i sent cca request

    Debt Managers (bank loan)- heard nothing since sent cca request

    Triton - Heard nothing from since they sent agreement (ue)

    Cabot - I decided not to make any payments, make a stand if you like rather than continue paying. I am going to send a f&f letter offering £100 at the end of this week and if they refuse it i am going to offer £3.50 per month (instead of the £5.47 I was paying, then gradually keep reducing this before making another offer.

    I will learn to play the game if it kills me!!

    From what has been said I would sit and see what RBS do next on the UE debt. Cabot are a bit unpredictable but yes I think I would do what you say if you are happy with that. It shows good faith on your part if they try to play rough at this point.

    as pixie says - see what they say! a month can be the difference between acceptance of a £100 offer or a £600 offer - it really does depend how serious they feel the account is (ie how serious you are about not paying)...

    Thank you Garlock and Pixie,

    I will write to Cabot and offer them what they were getting through dmp then and keep paying it for a couple of months, then try again with a full and final. I had a good read about this a few weeks ago when I found this site.. just wish I had found the site earlier!

    Do you know what I do now about the unenforceable debt i have with RBS? Do I need to do anything or just wait for them to get in touch, which they will now im not paying anymore!

    I think I would agree with you here Pixie. I would also suggest to Pooks that she has a good read of the F & F stuff around the site before making any further move on that front. Yes, after that make the £100 offer then move up a couple of times in £50 increments (only if you can afford it), then pull the offer off the table, tell them that your expenses have gone up ( e.g. energy costs) so that you are reducing your payments by a quid a month or so. Run with it for a while as Pixie says then make the offer again say £150 as a once only offer. There are template letters to start you off here on site.

    I don't know a lot about F&Fs but if they refuse the F&F of £100, just carry on paying the £5.47 then try again in a few months.
