    Update Apr 2017 from Santander "We may register a default if your arrears are not repaid. As you've not cleared the outstanding amount on your credit card, we have sent you a Default Notice served under section 87(1) of the Consumer Credit Act 1974 which you will receive in the next few days. As well as the Default Notice, you will also receive another letter confirming that if this amount isn't repaid within 28 days of the date on the letter, we will be advising credit reference agencies that you have defaulted on your account. This default will remain on your credit file for 6 years and may impact you getting credit in the future. It's also possible that your account may be passed to a debt management company who will manage it on our behalf. However, should this happen, we will always let you know in advance. Please note that once the default is registered with the credit reference agencies we'll close your account and any payment we receive afterwards will be used to reduce the outstanding amount."

    Ok this is the 2nd update on this debt today. Just received my default notice. I reckon they'll pass it on now to a DCA

    Ok so it looks like they are finally going to default this account. I haven't contacted them apart from the CCA request. I guess I'll be receiving a letter soon from a DCA about this account. I'm pretty happy with this result

    Just keep ALL correspondence (with envelopes if possible) together.
    We obviously don't know the actual terms of the Agreement all we know is that Santander called for the full outstanding balance in February.

    Niddy has looked at the s.78 and there is nothing to be gained with further correspondence with Santander at this moment.
    Seems to me that silence is the better approach at this time.

    It would be closed when its defaulted. Barclaycard added a couple of months of interest onto mine before they sold it, but mine was UE, do I sent SWID (in December) and haven't heard anything since. I'd also had a threatening letter from Howard Cohen so I sent them and LBA, but probably didn't need to do that as Robinson Way put the account on hold.

    If an account goes into default (ie repayments are not kept up) they are entitled to demand repayment of the full alleged debt. However they have since added further charges and interest, which suggests that the account has not been closed off.

    I would simply take them at their words this clearly says "..we now need you to clear the full balance outstanding of £x,xxx. Please make a payment by ringing us on xxxxxxxx"
    Without knowing the terms on the agreement I wouldn't know about other charges etc.. But the FULL BALANCE OUTSTANDING has been called for and this isn't the arrears or normal payments.

    Others might have other suggestions, but if it was me I wouldn't reply or have contact again with Santander.

    I disagree - it seems to me they are saying pay the arrears (ie overdue payments on the DMP), or else you will become immediately liable to pay the entire amount owing.

    But I don't think they have closed the account (yet).
