Ermmmmm tbh ;D I can't remember signing any for Kays. That doesn't mean I haven't though ...sieve for a brain unfortunately, which might just work in my favour if I'd forgotten to sign and return any Sorry

Ok so does this mean that they should provide separate fixed sum loan agreements and the running credit agreement for the one Kays account? Or should we just wait to see what they produce in answer to the SAR before I start getting ahead of myself

I would send the SAR - leave it at that for now. That covers everything about YOU that that lender has. So if you send it to Kays, it may well form other brands - you say you have more than one? Can I check did you mean you had more than one agreement or more than one actual account? If so, which brands?

Have Kays, Very and Littlewoods accounts. All SDG
CCA requested from all 3 catalogues. Didn't want to bombard you with all 3 in one go, will get the SAR off to Kays and then start with Very and Littlewoods if that is ok?

Will send Niddy the reply received to CCA request. I do remember signing this in the store, once again can't remember if they since have posted out anything for me to sign.

6/12/10 Letter received from NDR stating their client is about to issue a statutory default notice on this account, a debt collector will visit me at home, court proceedings maybe issued and all fees will be charged to me

7/12/10 NDR phoned to say their client is selling the account to a external DCA and will be adding a default.
14/12/10 Letter from Very offering to reschedule my outstanding balance for up to 3 years at 9.9% APR. ;;L bit late for that
28/02/11 Letter from Capquest, debt has been sold to them
3/03/11 Debtors final response CCA received letter sent
8/03/11 Telephone Harassment letter sent
27/03/11 Capquest have taken me off their call list. (Thanks Niddy Peace at last.)
03/04/11 Capquest letter with copy documents (application form and unsigned credit agreement?)
06/04/11 Niddy confirms recon still unenforceable, send copy document letter
07/04/11 Copy document letter sent
Account on hold while Capquest investigate

9/03/11 credit file alert Lowells placed default 31/01/11
6/04/11 Letter from Lowells, SDG have not forwarded the CCA, therefore Lowells will not be contacting me until they can send me the CCA.
3/05/11 CCA received, enforceable as before. Payment requested. Niddy says ignore
5/05/11 Voice text, emails and phone calls - Niddy says ignore.
16/05/11 Lowells passed account to Red. Letter received. Niddy says ignore.
3/06/11 Letter from Red offering 30% discount, pay or account to be passed to Hamptons legal -10 days to respond Niddy says send Threat by Lender/D.C.A - To commence litigation
9/06/11 Letter from Red - account passed to Hamptons legal.
10/06/11 Threat by lender - to commence litigation letter sent

Hiya ya , really sorry for the delay (been hectic - honest!)

Okies, this is now confirmed by Niddy as being 100% unenforceable so stop all payments, forget the interest they add on - it does not matter cos you won't be paying, a default is great! Means it'll be gone from your credit file in 6yrs!

Ok Thanks Niddy. Will sort some small payments out in the short term and look at it again when we see what the SAR brings from Kays. Thanks again dunno where I'd be without you.

Good results Tigger, now you just have to sit em out until the default drops off, so the quicker you're defaulted the better.
