      excuse my ignorance but is sending any letters to them then classed as 'contact' in terms of going for SB eventually?!

          Thank you. I have been ignoring and filing up to now. Is there any disadvantages to not sending them a letter please? Will it go against me in any way if they do step action up a stage?

            I can see that you have three debts with Cabot so there’s the potential for you to receive three times more texts than if you only had one debt.

            They should stop eventually.

            But if you feel you’re being harassed then you are being harassed, so the forum’s suggestion to send the template letter in post #91 may stop them in their tracks.

            It’s not nice to be harassed, and I think you’ve already had a field agent (doorstep collector) sent to your home by a Cabot, or have I misunderstood a previous post?

              If they are contacting you in a way other than that you have asked them to ( In writing) and its causing you anxiety, worry or distress - Its Harassment

              So why wouldn't you want to stop them by sending a letter?

              If they continue beyond receiving your letter - Then they are into dodgy ground with their behaviour - Behaviour they may have to justify in court if it ever got that far

              More likely Behaviour you would no doubt use against them should they decide to escalate things - I certainly would ( And have)

              But if you don't send the letter - You wouldn't be able to use it against them - Seems a simple choice to me

              I don't see that you have anything to lose by asking then to stop Harassing you

                Many thanks for your advice. I will send the letters as advised. To be honest I have felt able to just ignore the calls/text & letters but you are correct I did have an agent call to my home, which increases my anxiety as I have grappled with guilt in the past about not paying these debts back. Do I send just one letter to cover the debts I owe to Cabot or one for each debt please?

                  The thing is Blue, is that we have all probably suffered with guilt of not paying debts back, how I look at it is is that if the OC approached me to pay the same as what they sell them for then I’d be happy to pay them, scraping the money together by whatever means. If they are happy to sell the debt for a significantly reduced rate then why not to me? Why should I pay someone else full price for something when they brought it for a nominal fee? So now I sit and wait for the OC to sell it on and then prolong the time I go to battle with the cretins and leaches thus eating into the SB time.
                  everyone’s a winner (that needs too be)

                          • Is the debt subject to a Court Judgment? If not, are they, or have they, threatened to issue legal proceedings at all?

                            • No it’s not subject to county court. They keep threatening further action, however I have previously requested CCAs for all my debts and ones that have managed to provide appear not to be enforceable

                              • Hi,

                                Ok, so the relevant facts are;

                                1. Repeated insinuation of Court action;
                                2. No Court action to date despite insinuation; and
                                3. Resolvecall instructed.

                                Court action is not supposed to be intimated unless it is a genuine consideration. Continued reference to, yet lack thereof, indicates the 'lender' is aware the same is not possible, for many reasons including unenforceability.

                                Resolvecall are not bailiffs. They can't be, there is no judgment to be enforced. Its likely someone has been instructed to post a card through your letter box to 'reconnect' you with the 'lender'. An episode of long lost family it is not.

                                Monitor the situation and keep us all informed.

                                If needs be, we are a telephone call away. Do not let it play on your mind.
