    21/3/2013 - Double whammy to MH - Missing Prescribed Terms and Sold In Dispute
    30/3/2013 - Letter from Mackenzie Hall - account on hold
    5/4/2013 - Letter from Mackenzie Hall containing CCA but no prescribed terms (same single page Wescot sent back in December '12)
    8/4/2013 - Letter from Mackenzie Hall containing CCA but no prescribed terms (same single page Wescot sent back in December '12)
    15/4/2013 - Missing Prescribed Terms letter sent to Mackenzie Hall
    19/4/2013 - Letter from Mackenzie Hall containing CCA but no prescribed terms (same single page they sent twice earlier this month)

    10/5/2013 - Letter from Mackenzie Hall (I assume), containing exactly the same as had been sent before but this time with a statement of account
    5/8/2013 - NoA from Black Horse that account has been sold to Cabot
    5/8/2013 - Introductory letter from Cabot (in same letter as NoA letter!)
    5/8/2013 - Account Sold In Dispute sent to Cabot
    5/10/2013 - Letter from Cabot - threat-o-gram
    Letter received from Cabot - disappointed I haven't contacted them (despite letter of 5/8 been sent recorded delivery so I can prove I have), need to contact them urgently to discuss the account, failure to do so will result in further collection activity blah blah blah.

    I think I'll respond with a simple one liner referring them to the SWID letter.

    Read this tonight SnV, never laughed so much for a while, I have a load of UE accounts which have gone quiet, I was lucky all mine seemed to have got sold to Crabot, me and them have a lovely relationship, my letters always start with, now to stop wasting your time and mine here is the letter confirming that OC cannot/ have not got / CCA. Then they come back with there template yes we can't enforce but you remain liable for the debt please make us an offer. My final response, I have passed your letter to my pet West Highland Terrier in my legal desk to the right of mine and she say's to offer £0.00.

    Unlike you SnV I came straight on to the web sites to just brush up on consumer law. I worked for many years in the Financial Services investigating the miss-selling of pensions and endowments, what a blooming scandal mate, there was very few I could not uphold. Years of studying for qualifications and then when on the job I was so demoralized seeing such skulduggery one that comes to mind and never leaves me is that of Financial Adviser selling a term assurance policy to pay back a interest only loan. Yes it happened, glad to say even my bosses did not want to argue that one, paid the outstanding mortgage for the old couple straight away. Think they wanted to keep out of the public light. Went back into the NHS and have not looked back since. As for my debts after splitting from ex, I went straight for the UE if the OC sold them off or played hardball. Now I have a couple that I have CCA this week, like you I miss my sparring with the DCA's. So we shall see what Crap 1 and Mint come back with. Both pre-2007, so will get them off to Niddy as soon as they come.

    Morning AAd'ers!

    Some good news from Lowells today! This was my test case on challenging the charges that Shop Direct apply to accounts before selling them off to people like Lowells. As some of you who have followed my posts here on AAD may know I have queried the lawfulness of applying certain charges such as 'being unable to speak to you via telephone'.

    So this was a 'test case' because I challenged these charges with Lowell, as well as mixing it in with a SWID template letter. A bit of a one off special to test the water and it has had a result!

    Today I have received a letter from Lowell stating that while they believe that a debt may exist and is due, I quote:

    "In view of your comments we are closing your account with immediate effect and all information recorded with credit reference agencies will be removed"



    Now if you thought a debt 'may' exist and is due why would you go to the additional effort of removing CRA entries?........

    So I think I will also challenge the lawfulness of the charges applied to the other Shop Direct accounts I have. Fortunately they were stupid enough to send me letters for each account informing me they were applying charges because they could not contact me by telephone.

    Brief update on this - account on hold by Lowell.

    I find it funny also that in their letter they state that they enclose a copy of the complaints procedure (which of course there is no such copy). I guess this shows what they think of their complaints procedure!

    Seems its on an Arrangement - or that's the PDL's way of keeping harmful data longer than necessary. It should be a D within 6 months of non payment. I'd complain to the CRA and tell then you're in no arrangement, you're not paying and havent in over 2 years and then accuse the data controller (PDL) of fiddling the entry to cause harm and demand the data processor (the CRA) sorts the error.
    Hello mate - just copying a response you put in another thread rather than hijacking that one. I have a similar issue with Amex (see CRA entries below). I stopped making payments in June 2012. You can see that since then they have been recording payments as 4 months late for the last 15 months. Its an obvious attempt at keeping harmful data on my record.

    Only concern I have is should I raise the issue with the CRA then would this then flag anything with Amex?

    I guess the issue is that even if they stay quiet for the next 2 years, as long as they haven't issued a default with the CRA then its of no benefit to me (apart from being SB?)

    So should I wait for the debt to become SB and then challenge the CRA data? Or is it worth challenging it now?

    But I also have had fun with Freds and Farter Carter before - litte bit older/wiser now so won't be so much of a pushover this time (e.g. allowing Mr Carter to make 2 claims on a debt, one for his charges, and then the other for outstanding balance).
