thank you , i wouldn't need a calculator our income and outgoings are simple to calculate right now we have no spare cash for clothing or hair cuts like on some I&E forms , my hair is just long lol i never cut it, i cut hubby's hair . From this it should be easy but i don't know if there is any special way of setting out an I&E officially .

      Hi Hun,

One of the best ones around (until our site I&E calculator is online) is this one:

      http://mymoney.nedcab.org.uk/moneyadvice/quickfs.asp

Include life's essentials (like hairdressing!) even if you can't afford it. The online software will guide you through and I believe it goes if you overstate anything

You can then print it out and creditors should take it into account as it's a recognised and approved format. You then have comeback if they refuse to take your circumstances into account.

            Well done

For your reference, here's the latest version of The Lending Code, which states how the banks should treat hardship cases...

If this is your Lloyds CC, if it were me I would send this one

                    1) It is an extremely nasty and facetious letter. They seem to be trying to get you to send your defence to them before they have even issued a claim. Those four questions are irrelevant to the issue of unenforceability, and in any case they need to issue a claim before you have any responsibility to give admissions or denials.

                    2) Time is of the essence when you are trying to shepherd an account to statute-barred status, so I would just let the 28 days elapse and then counter their next attack.

If you did want to respond, I would suggest this -

Our Templates | Unenforceability Templates | CCA Query - Creditor Refusal to Accept UE Status

which would probably be the response I would give to their next threatogram whenever it arrives.

                    Does their letter really say

What have you been buying in Heaven, an angel for the Christmas tree?

                    SH

Just noticed this and yes it says higher purchase agreement i had to check the letter

If so, and they are making soft threats such as "may" do this and "may" do that, I would just send them this -

                      thank you

The CCA Reminder template won't be strictly accurate in this case, as it references ss. 77-79, which cover fixed loans, running account credit and hire purchase respectively.

I'm looking for the new overdraft CCA letter, so I'll know how it should be amended.

Was it the standard ss. 77-79 CCA request you sent, or the specialist one for overdrafts in Niddy's post which I've linked to in post #648?
