    Re: Starting out

I've spent far too long hiding behind a closed door, sometimes neglecting to maintain my front garden in case an unwelcome visitor decided to pay a visit. In the six years since my financial woes started I've not had one unwelcome visitor and I feel like a complete twat for all the times I jumped when someone knocked on my door.

The new and empowered me opens the door to whoever knocks, but just in case I should ever be taken off guard I keep a printed card handy along the lines of:

    Debt Collector Visit
    • 1) Ask the visitor to stand on the pavement, not on your land, while you stand within the boundary of your land.
      2) Ask to see ID and take note of the debt collector’s name, the organisation he is working for and any additional identity numbers etc.
If there is no official form of ID or the debt collector will not allow you to take notes from the ID terminate the visit immediately with:
"I do not want you to be here. Please leave."
Repeat this in response to any statement or question put to you by the debt collector.
      3) If you wish to terminate the visit tell the debt collector that the visit is over then walk away or go into your home and close the door. You are not obliged to give reasons or to say anything other than that the visit is ended and that you want the debt collector to leave:
      "Please leave now."
      4) If the debt collector does not leave then inform him that you will call the police. (If you do not believe that you will call the police then do not make this threat. You will lose all of your authority and the debt collector will dominate the meeting from that point onwards).

Call police on 101 or Your Town Police Station 01?? ??????

Explain to the police that you are being harassed by a man/woman who has visited you and who refuses to leave your property. Once again, keep calm but if you are frightened, then tell the police that you are frightened and that you believe that you need help.
If the debt collector leaves before the arrival of the police call them and cancel the call-out.

I've printed mine on a small (A5) sheet of card but these days I'm probably more likely to go with ScabHunter's laugh or just condense my card down to “Please leave”. What I'm trying to say is don’t be afraid in your own home or be intimidated by bullies.

Scabhunter you're letter sounds good and I feel I have to reply to them to stop them appearing at my door ,I don't want to be scared every time my door knocks .thank you all so much for your replies .

Don't be scared of anything whatever happens. If you do happen to open the door to one of these cretins, I think the best reply is to laugh, and then say "How much time and fuel have you wasted coming out here?"

That lets them know instantly that they won't be getting a payday. It is then just a matter of how much more time they want to waste before they waste more fuel going away again.

    Re: Starting out

You could always send them something like this, as it uses the OFT Guidance rather than the law as a deterrent -

    "Dear Sirs,

I am in receipt of your letter dated xxth June 2013, and note its contents.

You state that you “know of no genuine reason why you have failed to pay the outstanding balance”. This is blatantly untrue, unless you have somehow failed to read my communication of 22nd January 2013. This letter outlines the nature of the dispute surrounding this alleged account, so I refer you back to it to carry out the diligence which the Office of Fair Trading Debt Collection Guidance requires.

The Guidance also states, in Section 3.13 (f), that “visiting or 'threatening' to visit a debtor, without his prior agreement, when the debt is deadlocked or reasonably queried or disputed” constitutes an unfair business practice. It also constitutes a total waste of your time and resources, as I will not under any circumstances communicate with anyone carrying out such aggravated behaviour, other than by ordering them to leave.

If any doorstep harassment is carried out contrary to these stipulations, a formal complaint will be forwarded to the Office of Fair Trading, and also through your own internal procedure. This may result in the case being escalated to the Financial Ombudsman Service, who will charge you a mediation fee.

Instead of sending out machine produced templates in an attempt to frighten people, I suggest you carry out your due diligence by responding to my communications, as required by the regulatory authorities.

    Yours Faithfully,”
