    Hi Folks..

    Wee update..Please bear with me as finding this hard to write..Not been on here as much as usual (just reading posts)not been in a good place lately, suffering from Depression, Anxiety, Panic Attacks and poor concentration, came on all of a sudden at Xmas but didnt really understand what was happening to me (Wasn't long out of hospital after surgery and thought it had something to do with that). Finding it very hard to cope with at the moment.

    Hubby (mr M) not in good health at moment (lots of things going on) and our eldest Daughter who has been getting treated for headaches with Ibruprofen and Paracemtamel collapsed again and taking into hospital she needed fluid drained off her brain, too much pressure waiting for Neurologist report.

    As for DLC they have sent us two letters over the Xmas period offering us discounts but to be hones I just ignored them (hope havent ruined all Niddys hard work) everything just seems so muddled up in my brain even more than ever at this present time. Been put on medication but not sure how long it takes to help.

    Hope things good at your end good and everybody healthy...yeah DLC are bloody pests will try and hang them out for a few months, the way I'm feeling just now it wouldn't be worth their lives to come to our door...I'm ready waiting for them, fed up with all their threats . Will defo ignore them just now as got too many other bits and pieces going on.

    Will ignore Link also and will send SB letter if they do get heavy handed with their threats.

    I'm feeling much better nearly back on par but our Daughter has been very poorly in hospital so trying to help her. Hubby not too bad (touch wood).

    Bloody DLC are a pest!! Don't worry, if they do send a doorstep collector just play it cool and tell him your doorstep is not for sale and to leave prior to you reporting him to the Police for harassment, then walk away/ignore anything else (ie shut your door and walk away)

    Sent above letter to MDB was intercepted by dlc...they replied with letter below.

    We refer to your complaint letter dated xxxx addressed to Mercantile Data Bureau (MDB). This has been passed on to Hillesden Securities Ltd T/A direct legal & collections to respond.

    Complaint details (summary)

    Our understanding of your complaint is that you wish for MDB to stop harassing you. You state that you are in communication in regards to the outstanding balance and there is no need for a visit to your property. You state that MDB are not licensed and a report has been sent to the Office of Fair Trading.

    If our understanding of your complaint is incorrect, please inform us accordingly.


    Our findings

    Having investigated the claims raised we can confirm and advise the following:-

    · We have instructed Mercantile Data Bureau Ltd to act in regard to the above account.
    · Mercantile Data Bureau (MDB) Ltd is part of the Faccenda Group along with Hillesden Securities Ltd T/A direct legal & collections. MDV are a separate company to ourselves and hold their own consumer credit licence. Should you wish to view the details of this licence, you can do so by going to the Office of Fair Trading website.
    · MDB are a legally trading company and the appropriate returns will be submitted to Companies House in due course in line with statutory requirements. Due to the above we disagree with your claims that MDB are not licensed.
    · The last communication from you was July 2013 (THIS IS NOT TRUE) therefore we disagree with your comments that you are in communications with our company of MDB.
    · Due to the above point, we deny that any harassment has taken place within the meaning of section 1 of the Protection from Harassment Act 1997 or under section 40 of the Administration of Justice Act 1970. It is entirely reasonable for us, as the creditor, to communicate directly with the customer in relation to the repayment of an agreement entered into, especially where the customer is not legally represented we do communicate with the solicitors directly.
    · Should it be our intention to instruct our field agents, we can assure you that they will act in accordance with the guidelines issued by the Office of Fair Trading.
    · The balance of xxxx is correct and due. We would request you contact MDB to discuss the repayment options to you.

    Summary

    Further to the above, your complaint has not been upheld and your account will remain with MDB for collections activity to continue.

    We trust this now resolves the matter. Please confirm this by return wither in writing or by telephoning our offices by 14 October 2013.
    Niddy advise us to ignore this letter...

    Now received another letter from Dlc stating:-

    Further to our previous letter dated 7 october 2013 regarding the above account, we note that we have not recieved confimation that your complaint is resolved.

    We are now required to issue our final response as we have reached the end of the 8 wee timescale permitted to resolve complaints. Please accept this letter and our letter dated October 2013 (letter above), a copy is enclosed, as our final response in this matter.

    If you are dissatisfied with the outcome of your inquiry you may refer to the FOS. You must do this within 6 months of the date of this letter. A leaflet explaining how you can raise this matter with the FOS is enclosed for your information.

    You may also refer this to the Credit Services Association as the addres below.

    Cheers Pixie...... after doing much hunting round the house this morning found lots of paperwork to do with Link and a few wee bits and pieces regarding Instant Silver who has obviously contacted us before for these two accounts....been on the go for sometime long before we were knidly guided and helped by AAD.

    My Family says I was like a caged lion in hospital, was realy worried how Hubby was coping although our Daughters are a great help, so boring being in hospital epecially when you can't get up and move around.

    On the mend now each day getting better and better can't be ill for too long, Hubby needs me, so up and onwards as they say....

    Many Thanks MrsD hopefully recovery on track another week or so shoud do the trick, yeah absolutely positive it was 2007, in fact since being on here early this morning (was taking withdrawal symptoms from AAD in hospital) found paperwork and it seems May 2007 was last payment and to my knowledge have never acknowledge this debt with them....over past 6 months they have sent letters offering huge discount which we have ignored.

    But.. now they sent letter stating NOTIFICATION OF ACCOUNT TRANSFER TO AGENT stating they are instructing Instant Silver to take over managing these accounts....also checked through the paperwork I found this morning seems I have had few letters in the past from Instant Silver but manage to see them off.

    Good Morning folks

    Wee update....Fortunately not heard anything from dlc or MDB since 12/10/13 however new postman and mail seems to be going missing.

    Unfortunately I have been in hospital past 10 days (Emergency admittance) and when I was away our Daughters were looking after things here and I received 2 letters from Link Financial Outsourcing for 2 Accounts they have had for several years but have more or less left us alone apart from sending statements and few letters.

    Link state they are passing account to Instant Silver to chase these accounts but the last payment to these accounts I am sure was roughly 2007 (Scotland) so can I assume these are now SB. Would I write and advise them of this or just leave them to find out themselves. However if this meant attending Court I would rather advise them myself (Not in fit state just now). We received these letters just as I got admitted to hospital (21st Oct) but my Daughters thought it better that I didn't know about them due to my health, since then not heard anything from them (although as said above new postman who does not have a clue, we keep on getting neighbour's post so obviouly somebody is getting ours).

    Any pointers appreciated...now to go and catch up with all whats been going on here at ADD since I have been away.
