Oh cym if only Niddy and co could have been here sooner, CCJ do cause a lot of heartache. We also got one before AAD came along and a charging order, which both have now been paid off.
However, very fortunately for us cym , Niddy did save us major heartache when Elsa guided us to AAD from CAG (where we were just going round in circles). This site is just a life saver too many people like us out there, never will we be able to repay them., totally priceless. Hate to even imagine where our family would be today had Elsa not guided us here..

By requesting a CCA you are not acknowledging the account, even with a CAG request! I agree it is a shame that AAD didn't start a few years earlier as it would have saved me a lot of heartache and a CCJ!
if you have not paid for 5 years in Scotland then it is SB. Try not to worry, much easier said than done.

Totally forgot about this one, for many years only ever received statements from Link Financial every 6 months or so and maybe few leters saying pay up or else.
Never paid since 2007 so would expect it to be SB however on checking a few of the statements they have allocated a £1 payment to this account in 2009 which would have been payment for the CCA that we applied for in 2009 is this allowed to be added to the account to restart SB clock, sure I have read somewhere that this is not allowed but not sure if was on AAD or when I was on CAG (many years ago now).
Now received a letter from Robinson Way today demanding payment, anybody any pointers on what we should do.
They obviously don't think its SB or do they and are just trying to bully us into paying.
Robinson Way have replied today to our Statue Barred letter we sent them in April.
They say:
"Further to your recent query, please find a copy of a letter that yo sent to our client. As this acknowledges the account within the last 6 years, your account is not statute barred. Please complete the enclosed financial statement and return with your affordable proposal for payment within the nex 14 days".
They state 6 years but we all know its 5 years for Scotland so if they are correct still got till September 2014 again with this one also.
1. The CCA request letter they are referring to was from 2009 when I was on CAG (we all now know that CAg's template letters are not solid like AAD).
2. The CCA I recieved in 2009 has our account number hand written (we have original and there is nothing writting on this.
3. There was also Payment Protection included on this loan which was miss sold to me because I didnt work enough hours to make a claim.
Getting really worried about this one as we don't have £1,000 to pay them. Brain just totally frazzled just now due to personal problems, so really not sure what to do know.
Was thinking of sending Niddy the CCA (Recieved 2009) and copy of both letters recieved today
Oh how we wish AAD was about a few years earlier, bet this template we got off CAG was useless.

Many thanks for your kind words,. Mr M seems to be doing not too bad with Antibiotics and Fluids.
The Marlin PO problems isn't ours think S2M has posted it in wrong thread.
Will send Cap 1 a CCA request, but will leave it a few more days to waste more time. Hopefully by wasting time it will see us through to September but pretty much sure CCA not good.

Sorry missed this post Mr M was admitted to hospital yesterday with Pnuemonia (just to top everything else)
Exactly Elsa, she has conducted herself in a very unprofessonal way and to be honest with you that is why we(I) want another appointment with her (face to face) to tell her exactly what we(I) think.
In the meantime trying to deal with this Capital 1 lot that has raised their ugly heads.
Hope everything and everybody well at your end.. Your Grandchildren will be getting soooo big, where does the time go.

Many thanks cym had a funny feeling somebody was going to say ont be SB till September...just our luck.
May need to put this lot on back burner just now. Mr M been admitted to hospital yesterday with Pneumonia so need to prioritise things.
They did send me a CCA copy way back in 2009. Was wondering whether to either ignore them...or send another CCA request to try stall them till September when it will be SB.

Received a letter from Capital 1 for Mr M today demanding we pay them £392. Original debt was approx £1,400 but got charges refunded in Sept 2009.
This is for an old debt which we paid to Bryan Carter and Fredrickson when we were on CAG forum.(When we hadn't a clue!!!)
We have not paid anything to this debt since May 2009, however when we were on CAG we were advised to apply for our charges which we did, eventually got them through FOS in September 2009.
Now the question is would this be SB (Scotland) in May 2014 (since last payment May 2009) or because we applied for charges in Sept 2009 would that have restarted SB clock.
We did receive a copy of the CCA which was a really a small application box thingy that you receive in the post asking if you wanted a card with his signature and date (can send to Niddy if needed).
Really not too worried about this lot - got more things on my mind just now....but would like to know when we could consider it SB.
As always any help, pointers greatly appreciated.

Just received a reply from Marlin , they returned the PO saying i need to have it written to them , now I left the PO blank as last time i had it written out to a creditor it got returned saying it had to be left , so now what do i do , will the PO print Marlin on it or will it now cost me another 1.60 for a new PO ?

You are so right the so called professionals don't realise or understand the impact illness has on peoples lives...
Sometime I wonder how some of the Doctors/Consultants got into their jobs. Sometimes commmon knowledge works a lot better than some of their advice.
