    Don't worry, I'm easily confused so spell it out because I've looked at your other four threads and I see no mention of Shoosmiths. So which account has Shoosmiths got ? The credit card or the combined loan/overdraft account? Have you replied to the Shoosmiths' LBA yet?

    I think you're getting ahead of yourself with fears over a charging order. Try not to worry because there's nothing you can do at this time of night. We'll tackle this in the morning. Get some sleep in the meantime.

      I got the shoosmith notification last week, Its for the credit card account, guess I just need to make em a reasonable offer,

        If your (amalgamated) account has been passed to MC but MC have not yet contacted you, wait until they do..... and we'll take things from there.

        If the Shoosmiths's account is enforceable, then you should begin making payments to them but don't let them intimidate you into paying more than you can afford; property owner or not. The easiest way to start this off is to send a cheque....

          Cheers P1, .....was thinking of sending them a letter saying I'd like to pay and asking how to go about it, I was going to ask for an income/expenditure form, I did an online one and to be honest it was laughable how little i have left over each month! I guess it's just knowing how much to offer to keep myself out of court that's the tricky bit

            I wouldn't be asking them anything. if your payment is too low, they will soon tell you and we can go from there. How much is the debt and how much can you realistically afford?

                offer around £50pm to start. Pointless going in too high. Then save whatever you can till you get a few hundred and we can try and settle it early that way hence don't offer £100!

                    I'd be inclined to offer £20-£25.....

                      Ha, to be honest, I'd love to tell em what they would actually get if they took me to court, ...... but I really don't fancy a charge on my property or a SD, so I'm going to have to play ball ....a bit!!!

                        Well, you are.... just on your terms and not theirs. I used the wrong word in my last post.... "offer" is not what I would include in any correspondence. It should be more along the lines of "please find enclosed my cheque for £XX; representing the first monthly instalment re. your account ref. xxxxx" The likelihood of them taking you to court on the back of regular monthly payments is v small.
