Well, you are.... just on your terms and not theirs. I used the wrong word in my last post.... "offer" is not what I would include in any correspondence. It should be more along the lines of "please find enclosed my cheque for £XX; representing the first monthly instalment re. your account ref. xxxxx" The likelihood of them taking you to court on the back of regular monthly payments is v small.

I'd be inclined to offer £20-£25.....

Actually, I'd be inclined to start at £10....

Template & I&E here (login THEN come here and click this link) -> http://www.all-about-debt.co.uk/inde...-monthly-offer

offer around £50pm to start. Pointless going in too high. Then save whatever you can till you get a few hundred and we can try and settle it early that way hence don't offer £100!

I wouldn't be asking them anything. if your payment is too low, they will soon tell you and we can go from there. How much is the debt and how much can you realistically afford?

If your (amalgamated) account has been passed to MC but MC have not yet contacted you, wait until they do..... and we'll take things from there.

If the Shoosmiths's account is enforceable, then you should begin making payments to them but don't let them intimidate you into paying more than you can afford; property owner or not. The easiest way to start this off is to send a cheque....

I got the shoosmith notification last week, Its for the credit card account, guess I just need to make em a reasonable offer,
Hey, thanks to this site and reading about everybody else's experiences I'm not overly worried, it's nice knowing that we're making decisions through being educated along the way, thanks for your help , g'nite

I've got two accounts with marlin,
One with shoosmith and one now with mc .
One is a credit card and one is a combined/amalgamated debt (loan and overdraft)
Any ideas how to go about making a monthly offer that will avoid a charging order?!
Don't worry, I'm easily confused so spell it out because I've looked at your other four threads and I see no mention of Shoosmiths. So which account has Shoosmiths got ? The credit card or the combined loan/overdraft account? Have you replied to the Shoosmiths' LBA yet?

I think you're getting ahead of yourself with fears over a charging order. Try not to worry because there's nothing you can do at this time of night. We'll tackle this in the morning. Get some sleep in the meantime.

Okay. Sorry to be so dumb, have I got this right now:

Marlin have passed your HSBC current account to Shoosmiths solicitors who have sent a LBA (have you replied?)

    and

Marlin have sent you a letter saying that they're passing your HSBC personal loan to Mortimer Clarke solicitors who haven't written to you yet.
