Spent yes he could if you draw up a formal agreement so that the hb dept at council can see its an actual rental not just a let live sort of thing. I looked at this all a few yrs back when my mum was looking to sell her house.

thank you this is really helpful, my son would be sharing it with a few mates who i know from when they were all little so well trusted, this seems really promising now , feeling better already

There's plenty of case law to back HB for family members but I would expect your son to be turned down initially and have to go to Tribunal to make them pay.

The best way to avoid that delay is for his Landlord on the tenancy agreement to be *Spent2Much Ltd* or similar which avoids any obvious family connection That's legal too. If you haven't got a spare company for property management then set one up online for £4.99 through a formations company Of course if a company is getting rent then you aren't getting it are you? That company may pay you a pittance of a wage/fee.

Probably best not to put too much on an open forum though

That's even better as the names will become a blurr.

I once saw an eviction warrant in the name of Mickey Mouse and Pluto (2nd Defendant) because those were the names the squatters gave to the police who came to the house. Neverthless the court order didn't materialise and the trespassing cat and dog remained in situ

The more the merrier. The council will go with whomever is named on the tenancy agreement. Nowadays it's a housing allowance based on postcode and the claimant's age (under 25s get less for some odd reason), and not the actual rent so there could still be a shortfall if the rent is too high, so do your research thoroughly before putting in the claim.

                Plan B x

You can incorporate a limited company online for only £4.99 because I did it recently. Plan B isn't just a pretty avatar you know

That's fine by me but clear it with Niddy first because some things are best said by PM or email and not on an open forum however lawful they may be

I would use pm or email for sure as i don't think it is something to be posted on a forum

still thinking of selling and renting for a while, it would work out both ways for us , i get an in heritence when my parents are gone which is a share of their house and it will be at least £ 30,000. I hate thinking about it but its something that my parents keep telling me to look forward to as it was always their intention of leaving their children something .

Bare in mind that you have a charging order on this property which your solicitor will want to pay in full when you complete on your sale. You haven't said who the creditor was (Eversheds are solicitors) or how much is the balance and whether you're paying this by instalments at the moment

The good news is that once you've sold your house and moved into rented accommodation you won't run the risk of getting any more COs will you
