    Called the Court in Cardiff just before Xmas, still no date for listing. But am still worrying and investigating what the CSA Tribunal can do. CSA have turned down all 3 of the applications for variation by parent no 3. I would still like to argue my case that they should have used the figures initially requested and supplied by my accountant (7 months figures for the "new" partnership). They have used "historical HRMC figures" my argument is that this is a new firm that has been formed.

    Do we have an expert accountant on the forum? I need to understand the law on "Technical Dissolution of a Partnership" I have found an item that says "A technical dissolution takes place each time there is a change in the composition of the firm - ie., technically, the partnership is disolved each time one partner leaves (and is replaced by another), or a new partner joins. In such a case there will usually be no break in the business of the partnership with the "new" firm generally taking on the assets and liability of the "old"."

    Is this actual accounting law?

    Here's a radical suggestion. Why not deduct that money from your son's wages since he's the father of these kids? That should make him realize he has responsibilities.

    This is dragging on. Still no date for 2nd Tribunal hearing. Accountant charged me £860 for preparing figures. Advised that I cannot claim this as a business expense.

    Still waiting for a date for second hearing, wish they would hurry up so that we can just resolve it!

    The only thing that I can think of is, did they do the initial assessment in accordance with the regulations? In my opinion, no. They should have used his share of the partnership profits and not hmrc figures. Case law on this.

    This woman has changed her "evidence" so many times that it is unbelievable, she has applied under every circumstance for a variation.
    Is this a victory for your son? Are you saying the CSA has refused Mum 3's application to vary because they don't accept her evidence?

    In which case what is there left for the Tribunal to decide next month?

    Looking through latest paperwork, to be added to the 411 pages already received. The CSA have done a credit check on my son through Experian. Cannot see why they need to do this?

    Received the submissions from csa to tribunal. Assets of more than £65000. Variation refused! Lifestyle that is inconsistent with the income he has declared to the child support agency. Variation refused! Diversion of income. The application was refused as there was no evidence of diversion in the decision under appeal!
    This woman has changed her "evidence" so many times that it is unbelievable, she has applied under every circumstance for a variation. I have not yet received the invoice from my accountant but it will run into hundreds of pounds. Just unbelievable that a woman on benefits can get away with so many lies. Will now await a date for 2nd hearing.

    Maybe the CSA put pressure on her to justify her reasons for rejecting the application to vary?

    Which Tribunal is dealing with this? Forgive my ignorance but is it the "Social Security and Child Support" Tribunal now known as the "First Tier Tribunal Social Entitlement Chamber"?

    Found tribunal rules and procedures.the judge can change appellant and respondent.Still not sure why she did.Call from csa yesterday,final rejection for variation by mum 3,She tried to give csa information from our bank accounts! Against csa rules to use this.
