They threat to send someone to my home - They have already been. Then say they can offer me up to 20% subject to your personal circumstances...

    - Shoosmiths wrote back saying they are no longer the acting Solicitor and it has been passed to Wescot.
    - Letter from Wescot - Notice of Debt Collection, blah, blah
    - Wescot - Final Notice (a few days after the first letter from them)
    - October 2012 - Nelson Guest & Partners Solicitors, instructed by Wescot on behalf of RBS.
As a final attempt to avoid further action, Wescot is prepared to offer you a discount to settle your account.
    - A/C in dispute sent.
    - 3/11/12 - Letter off Nelson Guest & Partners Solicitors.
We are instructed by Wescot acting on behalf of RBS. Whilst Wescot is still willing to consider realistic options for repayment based on your personal circumstances, this matter cannot remain outstanding any longer. Unless full payment is made to Wescot, or a suitable repayment plan is agreed, within 10 days of the date of this letter, further recovery activity will be undertaken.
    - Letter from Wescot arrived today dated 10/11/12.

Thank you for your letter, etc... We acknowledge that you have raised a query on this account and we would like to confirm to you how this will be investigated.

Goes on to say they will suspend any further activity on the above account due to this and will be in touch....

    That is okay by me....

16/11/2012 - Letter from Wescot saying that they refer to my recent communication and having contacted our client they have advised that the above balance is correct and payable. Our client has confirmed that your CCA request was complied with on 15.5.2012.

Goes on to say about the dispute has now been resolved and the full balance is payable. Not sure what to send next?

    UPDATE - HALIFAX CC

    Halifax CC
    Defaulted March 2011
    £10.5k
    - Passed to Wescot - Requested CCA January 2012 - Refused as they where not the creditor!

    - Re-sent the CCA request - Wouldn't send it to me as above.

    - PT Letter sent

    - Passed to Robinson Way Limited March 2012 - A/C in Dispute sent

    - Robinson Way sent ALL CC Statements - June 2012

    - CCA received June 2012 - (No PO ever cashed)

    - Sent PT letter

    - Halifax - July 2012 - Instructed Moorcroft DCA to deal with my A/C
    - Moorcroft sending threatening letters & Offer of DISCOUNT up to 25% or greater depending on circumstances!

    - A/C in Dispute letter sent - September 2012

    - Halifax replied September 2012 - CCA already sent. That they have complied with with S78 of the CCA that they have provided me with a copy of my CCA. Halifax goes on for quite a few pages basically saying that they have done everything that has been asked of them and the CCA is EN and that they have sent another copy of the CCA, which they previously sent in July after months of requesting it. Niddy deemed this - The Halifax have also mistaken me as being a representative of myself! LOL

    - Moorcroft then replied to my A/C in dispute letter Sept 2012 - looking in to it the dispute.

    UPADTE OCTOBER 2012

    - Moorcroft letter October 2012 - Letter to say that the HALIFAX HAVE NO RECORDS of my original CCA request letter??????please forward this to them to enable them to re-request a copy of my CCA.

    - A/C on hold.[/COLOR]

I am slightly confused as they have now sent out a few CCA's after ignoring me for ages and refusing my request's by letter from January 2012 - July 2012, It is at this time they decided to send the first copy of the CCA!

Even if I did re-send a letter requesting a CCA because they havent got one on file I have already sent out 4 requests only to be told my signature wasn't signed by hand therefore refused my 4 requests!

2 Nov 2012 - Received a letter from Moorcroft HOME COLLECTIONS DIVISION - Discount offer.

Ok. So far with Mint I have tried to come to a payment agreement and they didn't even answer me. They have had DCA then solicitors then back to DCA.... I am a little bit puzzled at them to be honest... I am a bit lost as to what letter to send next?

They say the usual that they regret that I feel the need to express my dissatisfaction. They are currently looking into this and will respond within 20 working days.

Will come back to this when they contact me again and also need to just check the CCA they sent last time is the same as the one I have got which I will send to Niddy tomorrow morning.
    UPDATE - CABOT

Just opened all the post for the day and the last one is Cabot...

After sending P1 letter they gave the 20 days to respond as I have said above. They have literally sent this letter out a day after the other one.

    Its says:

Repaying your account - our offer to you

Our aim is to help customers get their accounts cleared and so we're prepared to accept a one off payment of £x half of the full amount. This is for a limited offer which is only available for the next 30 days....etc.

Just received a letter back from Wescot Re: Mint to say that they sent a CCA in May and therefore there is no longer a dispute.

In theses circumstances we believe that the full balance and or an agreed amount monthly instalment is required by return. Etc....

Spoke to soon. They were very quick to answer that one

There is one, Additions, that has been sending letters from Lowell on behalf of Shop Direct. They sent the CCA in September which I completely forgot about until I received a letter from HAMPTONS Solicitors asking for payment or further action 'could take place'.

The CCA is from 2006 and has no signature on it. All it has is my name and address at the top and no signature below and the next 2 pages is an up to date 2010, again with no signature and no name and address at all on.

Will copy and send to Niddy just to check before this one goes any further and do an a/c in dispute letter now for it.
Most SDG agreements are UE. It's also unlikely they'll pursue as one bad defeat would open the floodgates - cue Mayhew kicking Santanders arsey

I'd send off the account in dispute as well. See what they come back with
