    Received a letter this morning from Bryan Carter Solicitors about my Capital One card (UE). They're giving me 14 days to pay in full or they will recommend that their client issue proceedings.

    Fredricksons had the Threat-O-Gram: Letter before action in June.

    Hi Pixie,

    SCM and Lloyds Collection dept appear to have very poor communications (despite both (apparently) being in the same building. I have an overdraft with Lloyds and some other products that were all part of a DMP at one time. I also received various threatening letters from SCM despite agreeing payments (and keeping to them) with the Collections team.

    My course of action was to continually make use of the Lloyds complaints procedure with multiple complaints and also to use the FOS.

    Having said that, dear old Lloyds have recently started applying charges and interest again that is (monthly) 50% larger than the agreed repayments - and they refuse to change despite the fact that it is continually increasing the debt and will, within a few months, cross the overdraft limit and incur more charges. All this for a facility I have not used since early in 2007!

    So it is back to the FOS again ...... currently waiting the 8 weeks for Lloyds to reply. Ho Hum

    Nooo, I wanted to see the letters lol - but yes, you also know the other reason (as I always delete after reading).....

    Yes, send off your I&E and make the £1 per month offers, if anything send a copy of the recent order from the court that shows they have accepted this.....

    Any advice re LTSB overdraft? (see posts#308 and #311)

    Do I write/fill in I&E form saying I'm now unemployed and offering £1 a month or just ignore and see what they come back with?

    So they're offering me the chance to pay £120 a month to stop them recommending to their clients that solicitors commence legal proceedings. Hey, I'm unemployed!

    Another big yellow 'confirmed resident' card from Fredrickson's.

    This is for my Tesco card and is different from the one I received from them in February for my Capital One card. This has the additional wording 'or your account will be passed to solicitors with authorisation to proceed with immediate litigation proceedings against you at the above address.'

    I sent Fredrickson's the 'Threat-O-Gram; Letter before action' letter yesterday in response to their last letter so should I ignore or send 'Threat to commence litigation' letter?

    This letter was received on 12/07 and was from SCM Solicitors about my LTSB overdraft (formal demand for payment prior to commencement of legal proceedings.) If the outstanding balance is not received within 14 days from receipt of the letter, they may issue legal proceedings. There isn't a cat in hell's chance that I can pay it (can't, not won't).

    However, since then I've had the letter (from LTSB themselves) mentioned in post #308 asking for I&E form to be completed.
    If it helps,
    on my LTSB overdraft since the formal demand from SCM I have:
    had a letter from Lloyds saying they will temporarily suspend legal action for 10 days,
    then a recently contacted me with an offer of help but now they are passing it to collections and will be putting a default on my record,
    then collection center sent me a letter telling me about their new online service where I can see status and balance, make payment or notify them of financial difficulties,
    then SCM sent me a notice of court proceedings saying client may issue proceedings without further notice,
    then another letter saying that they and lloyds do not appear to have received any communication from me and it is my last opportunity to avoid court.
    Formal demand sent end April, last letter was beginning of July to give you a timeline.
    I have sent them letters, but thats not for your thread, its for private area if court action is taken.
