    I have Capquest handling a couple of my alleged accounts, in view of their management shake up and "New Approach To Business" it may be wise for us to be a little more vigilant with the responses now.

    October letter asking me to phone them if I've not already made a payment or if I think there's going to be a problem making future payments on time ignored
    November Telephone harrassment letter sent
    November letter received saying that I'm in arrears and have to call them to explain my conduct
    December received a 'card' saying that their representative would be calling my home and to ring if not convenient - the date for the call is 2 days before I received the card!! no visit or phone call received on that day dy :bert
    December received a letter saying that my phone number is being removed from their system
    December received letter from power2contact saying that LTSB have lost contact with me. If I don't get in touch with LTSB in 3 days they will instruct one of their 'Resolution Officers' to visit me at my address
    December sent 'sold while in dispute'/'doorstep visit' combination letter to power2contact
    2011
    January Letter received from SCM Solicitors saying to pay within 14 days or legal proceedings may be instigated against me without further reference.
    January 'Threat by lender/dca to commence litigation' letter sent
    February Letter received from MHA Collections asking for the arrears on the account to be paid immediately. If I don't pay SCM Solicitors may commence legal proceedings.
    March 'F&F Special Offer' letter received from MHA collections
    March 'Reduced monthly payments special offer' letter received from MHA Collections.
    March Letter received from MHA Collections asking me to phone them urgently - and I can even use a phone at a LTSB branch.
    March 'Account sold whilst in dispute ' letter sent to MHA
    April letter from MHA. They've passed my 'account in dispute' letter to LTSB. They also want me to call them to talk about my account and want my contact number ignore
    April Letter received from LTSB saying they've received my complaint and sent it to their 'specialist Customer Relations Department' ignore
    April Letter from LTSB disputing that the cca is UE. ignore
    May Received notice of intended litigation from Moorcroft
    May 'Threat O Gram - Letter before Action' sent to Moorcroft
    May Received a letter entitled 'Important Information-Possible Litigation' from Moorcroft
    May 'Enough is enough' template letter sent to Moorcroft
    May Letter received from Moorcroft saying account on hold while they investigate (presumably in response to Threat O Gram letter as they haven't had time to receive and respond to 'enough is enough' letter
    July Letter received from Moorcroft entitled 'Important Information-Possible Litigation'
    July sent updated 'Threat O Gram - Letter before Action'
    July Received a 'monthly instalment offer' from Moorcroftignore
    July Letter from Moorcroft. Account put on hold while they investigate.
    August Letter from Moorcroft. Account put on hold while they investigate.Again!!
    September 'Formal Demand for Payment' received from Robinson Way
    September 'Account sold while in Dispute' letter sent to Robinson Way
    OctoberLetter from Robinson Way - collection activity stopped while they make enquiries about my dispute.
    November Letter received from Robinson way saying that they're still waiting for a response from LTSB - even though they've reminded them that the query is outstanding

    February Letter from Fairfax Solicitors requesting immediate payment of full amount or they may commence legal proceedings
    February 'Threat to Commence Litigation' letter sent to Fairfax Solicitors
    February Letter from Fairfax Solicitors - they weren't aware that the account was subject to cca request so account on hold
    February Letter, 'agreement' and T&Cs received from LTSBThese are the same as those received 18 months ago so I'll see what they come up with next
    August Letter from Credit Security Limited saying they've been instructed to recover the debt
    August "Account Sold While in Dispute" letter sent to Credit Security.

    2013
    July Letter from Capquest. LTSB have sold the account to them and Debt Managers have been appointed to manage it.
    August Letter from Debt Managers wanting immediate payment of full amount or contact them to make a "reasonable and realistic" payment arrangement.
    August "Account Sold While in Dispute" letter sent to Capquest.
    August "Account Sold While in Dispute" and only communicate in writing letter sent to Debt Managers.
    August Letter from Debt Managers. They are no longer dealing with the account, file closed and returned to Lloyds Banking Group.
    September Letter from Capquest saying that LTSB have no record of CCA request being received.
    September Copy of original cca request and copy of LTSB's response sent to Capquest.
    October Telephone Harassment letter sent to Capquest
    November CCA Request sent to Capquest
    After the discussion last night on The Scarednshakin's diary I have sent a new cca request to Capquest today. However, I've now received a letter from them in response to me sending the copy of original cca request and copy of LTSB's response in September. It says that it would appear from Lloyds response that a copy of the agreement was enclosed with the letter (it was but it was UE) and to confirm if this was not received.

    I just get the feeling that they're trying to trip me up. I think I'll wait and see what I get back from the CCA request sent today.

    Letter received today form Clarity re MBNA/Arrow Global account with application form and T&Cs - exactly the same as sent to be by Arrow Global in March 2011. I'll send the Missing Prescribed Terms letter to them - just as I did in March 2011.

    Today I've received a letter from Capquest re my LTSB credit card account (UE) http://forums.all-about-debt.co.uk/s...ull=1#post8949 saying that LTSB have no record of cca request 1974 being received. They want me to provide a copy of the original request along with evidence of the £1.00 fee. They go on to say "The client state that this was previously requested but they have received nothing." Just goes to prove what liars bankers are!!

    I haven't got the postal order receipt (I threw it away when I received the cca...yes, I know better now!) but I have got the letter I received from LTSB saying "I write in response to your request for a copy of your consumer credit agreement ..." I'll send a copy of that along with a copy of the original cca request.

    It seems that saying they haven't received the original cca request is LTSB's latest trick as jillyiant received a similar letter a couple of weeks ago http://forums.all-about-debt.co.uk/s...l=1#post345045 (different dcas though.) I wonder if it's their way of breaking the template "path"?

    Sorry vint...I've only just seen this (I've had other things on my mind) I received a letter from Arrow Global in October 2010 saying that MBNA had "assigned all of its respective rights, title and interest in respect of the above referenced account." I didn't receive anything from MBNA.

    I've received a letter from Arrow Global (MBNA credit card originally - UE) saying that the management of the account has been transferred to Clarity Credit Management Solutions Limited. It makes you wonder why they bother. I'll send http://www.all-about-debt.co.uk/inde...lst-in-dispute to Clarity.

    I've received a letter today from Debt Managers re LTSB credit card (UE). They are no longer dealing with the account and the file has been closed and returned to their client Lloyds Banking Group.

    I've only had one letter and a few phone calls from them so they've given up pretty quickly!

    Just one thing puzzles me. I had a letter at the end of July from Capquest saying that LTSB had sold the account to them and the letter I received from Debt Managers a week ago states "our client Capquest". However the letter saying they are no longer dealing with the account says they're returning it to Lloyds Banking Group and all future communications should be made directly to "our client Lloyds Banking Group".

    Has the account been sold or not? Doesn't really matter either way because I'm not paying Lloyds or Capquest.

    Ah, phew. It's just standard wording. I thought my case was special, but not so, I'm relieved to see(!)

    Ooops. I've just checked and I sent the missing prescribed terms letter to Arrow Global I'll update my diary.

    The letter from Arrow Global says the account has been assigned to them by MBNA. It goes on to say

    In response to a request for copy documentation under Section78 of the Consumer Credit Act 1974, we enclose:
    1. A copy of the agreement;
    2. A copy of the terms & conditions;
    We confirm:
    a. The account is in default; and
    b. The total sum outstanding is £X

    Please now provide your proposal for repayment of your debt. Failure to do so will result in the continuation of collection activity, which in your case may include litigation.
    I hadn't asked Arrow Global for a cca.

    Hi Pip. I hope so too!

    I'll have a look in my file for you. I probably didn't reply as a reply isn't recorded in my diary and I'm usually pretty good with recording everything.

    November Letter from Debt Managers. They are unaware of any dispute so contacting clients. Also dealing with my dissatisfaction (doorstep visit) through their complaints process

    2013
    January "Account on hold" letter from Debt Managers
    February Letter from Debt Managers saying that Arrow Global have asked them to continue with collections as there is no outstanding dispute on the account. Also enclosed I&E form for my repayment proposals

    Hello Pixie!

    Sorry to dredge this up! I'd really appreciate hearing a little more about the wording of the letter from Arrow Global in March 2011 when they sent the application form and T&Cs. Also, there's nothing listed about in the diary, but did you reply to Arrow in response to their sending the application form etc? Just I find myself in a very similar situation today but they did enclose a sternly-worded letter even though it's the first thing I've heard from them in six months.

    I hope I don't jinx this sleeping dog back into life for you by asking about it ...
