01/11/2011..Hubby 'bumped into' collector,said there was no pressure could pay £20 per week and where did we get CCA letter from. We could just ignore it and carry on paying.

Sorry. Feeling swamped and totally out of my depth this week. Just received SAR back from Co op. Literally thousands of pages so not sure what needs to be be seen. Know its all in hand but just feel a bit lost cos got a few things all happening at once. Sorry and HELP please

Hi samsmum,
Firstly this payday loan thing, is not Niddy looking into this for you as he knows the company you don't wish to reveal on here which is understandable? Was there not some issue of them stepping out of line by talking with your OH in the street? He will still be watching the thread and will be along with the next move.
Secondly the Co-Op thing. You have received a SAR response yes? Thsi has turned out to be a wad of paper which is what they usually are. I have not read all the way back but is not the agreement UE anyway?
So in dealing with the SAR package, they usually contain 6 years worth of statements. Isolate those and put them into some chronological order. Then look at the correspondence, screen dump notes, internal memos e-mails and the like. Check everything aginst your own memory and correpondence you hold for anomalies and contradictions, errors etc. and make a few notes. All banks tell lies, part fo the mantra.
Look at the statements carefully for penalty chrages and late payment chrages normally about £12 a pop. These can be reclaimed noprmally with 8% statutory interest without too much hassle. There have been very successful claims of compound interest at their current contractual rate in the past but you may to fight for that through a court action. (I don't recommend that). However be aware that there is some contention in reclaiming those charges when looking at UE and Satutue Barring as there is a school of thought that says that the clock would be restarted at the claim date and that you are in fact acknowledging the debt, weakening any UE defence you might use in the future.
Niddy will provide the best guidance on this.
So don't panic and the very ebst of luck for tomorrow.

Yep that's right about the local firm. Heard nothing back about the CCA request, just the text yesterday.
I'll get onto sorting through the Co op forest as best i can and wait to hear from Niddy as you say. He's also gonna draft me a letter for Reliable Collections regarding my'' unacceptable conduct which will not be tolerated''. Both this and the Co op are ue as you say.
