Crapital One.... Now Capquest have written saying they have checked and everything's compliant and that is their final response ...

I would love to think that it means they wont' write to me again but I hardly think that is the case.

Not sure whether it's worth responding with the EnoughIsEnough template or something else? Basically they had sent a recon (short application form and recon T/C) which Niddy said is UE.

It's been through other DCAs who've closed and handed back. I'd like Crapquest to do the same.

    Niddified and proud!

Fought and won the UE battle, thanks to Niddy and this forum...

Ah no roses or chocolates as yet... but Crappy One have written saying much the same as Crapquest. They reckon they have complied and that's that. They say they have sent copy of current Ts and Cs , recon of my original agreement and scanned copy of sig page of my original agreement.

Interestingly they then say they will defend any action I bring, and they'll continue to request payment. No mentin that they may bring any action themselves....

Update: Moorcroft (NatWest, UE). Moorcroft have been quiet for a few weeks, they've had the Account Sold letter and put it on hold while they investigated. Well they have obviously finished investigating as they have now sent a letter "Important Information - Possible Litigation". They say if I don't contcat them on receipt they assume I'm avoiding repaying so they may recommend that their clients issue legal action. And they list lots of charges that might add to the debt etc etc.

I presume i send the Threat of Legal Proceedings letter - they haven't had this yet. Although their letter sounds a bit woolly.

Oooh and they say they may be able to offer me a substantial discount if I contact them! (Aren't I lucky).

... well I thought it was but it's just a different trading name.

It's MBNA that got sold to Hillesdens/DLC, been going round in circles with them a bit and lately they've gone quiet. However got a letter from "Mercantile Data Bureau Ltd" (which I think is just DLC in another name as they say it's an associated company) andn they mention they may visit me. And they'd like me to phone. Aw bless.

I presume I send Account Sold and Doorstep Threat letters, but am wondering whether I need Account Sold if they are already saying it's an associted company?
Interesting to note: this company is Hillesdens/DLC just trying to put the frighteners on. They use a Freepost address on their letter... the cynic in me thinks this might be to try to avoid accepting recorded delivery letters? Anyway I know they are Hillesdens/DLC so I've used the Hillesden/DLC address and it's gone recorded.

                        Hi, some advice needed.

At the moment I'm making what I think are reasonable payments on the two Enforceable debts I have and they'll be gone in a few yrs.

When first defaulted our situation was absolutely dire and we didn't have a bean. Or half a bean. However, the financial situation is improving and I could afford to make small payments to the UE debts. Not anything like they would like me to though!

They all defaulted about 18 months ago, some nearly 2 yrs, and I have paid nothing at all on them for over a year. The template letters seem to be staving them off and we're doing the DCA merry-go-round. But I'm concerned that they could start issuing proceedings. (Although hopefully none would have enough documentation but they could always "find" it I suppose).

My question is this: if I make small regular payments are they likely to start sniffing and try it on - am I better off letting sleeping dogs lie, or would small regular payments be more likely to stave off any attempt at court action? They'll be SB in 4 or so years.

                        Thank you.

just send the doorstep threat - thats fine
They have sent a further letter which presumably crossed with mine - saying that as I've ignored their letter they've started profiling me and if they find I'm a home owner or employed/self employed they may instruct a 3rd party to collect. As it's obviously crossed with my letter I'm ignoring this for the moment. They've now had the doorstep threat letter so if they do send the heavies that's their risk.
