    Thanks Niddy, I'm grateful for your kind (and bloody quick!) replies.

    I did send missing prescribed terms to Rossendales on the 14th July http://forums.all-about-debt.co.uk/s...7&postcount=58 however I'm happy to send it to them again, and will cc it to Arrow (as they have been assigned the debt and also wrote to me).

    One quick point; you refer to the Cabot v Bachellier case. Should I try to adapt the template to refer to that case, or am I okay to send it as is.

            Good day all, nice of you to visit me.

            Further to my diary update of the 15th August when I sent the "missing prescribed terms" template to both Arrow (Assignee) and Rossendales (DCA), I have now received the following letter from Arrow:

            In response to a request for a statement under Section 78 of the Consumer Credit Act 1974, we enclose:
            1) a copy of the agreement;
            2) a copy of the terms & conditions;
            3) a copy of the Originators statements;

            We confirm:
            a) the account is in default;
            b) the total sum outstanding is £squillions;
            c) the amounts which will become payable comprise of interests and costs, depending on what enforcement action is taken against you.

            Please now provide your proposal for repayment of your debt. Failure to do so will result in the continuation of collection activity, which in your case may include litigation.

            This account is currently being operated on our behalf by Rossendales. We will deal with this document request only and all other enquiries should be directed to them.


            The documents enclosed are no different to what I have received previously, however, Rossendales have now started to ring throughout the day and this is the first threat of legal action.

            I would be most grateful on any input on how best to proceed, lovely people of the interweb

                    Letter received from Apex, enclosing letter from Barclaycard (different letter to that which I've previously received) and what I believe is just T&C's.

                    Emailed to Niddy for comment.

                      So they're quoting CPR etc at you - fine, thats cos they think you're taking action and have omitted CPR process (ie letter before action blah blah) - but that's the error, they "think" you're taking action - but you're not!

                      As for the actual agreement, well thats a cancellation form - where's the agreement then? Nothing signed on it, if so then it'd be cancelled as it's a cancellation form!

                      This was an old staff card of a building society, the terms are associated to a barclaycard from 2008. They need to send terms from inception and current ones - not just the current ones, muppets.

                        Just a quick question diddly if I may?

                        You mention a letter enclosed from Barclaycard in the previous post. Can I ask was the letter genuine. Was the return address on the envelope and address in Bristol? The one we had enclosed with a letter from Lowells purporting to be Barclaycard's Notice of Assignment was almost certainly a forgery. The logo was green and purple, it was the incorrect size and placed incorrectly on the paper which in itself was semi- glossy which Barclaycard have never used in anything previous to us and there is a lot to compare it to. The font was one we had not seen before either. I know NoAs can be on toilet paper but this one is just so wrong.

                        Hence I am wondring if Barclaycard are sedning these thinbgs out via debt purchasers genuinely or whether the forging habit is now spreading and I would like to bang a few more nails in Lowells coffin.

                            Yes mate, i've seen loads of them before - its a standard reply to omitted s.78 and where we mention a court order under CPR (31.16) they respond to it assuming we are threatening court - incorrect assumption of course, but it does come from Barclaycard - not a DCA.

                              Hi Garlok.

                              The logo is blue and purple on mine too, but paper isn't glossy, and it is the usual Barclaycard font and return address on the letter!
