    Dear diary - so sorry you have been neglected, but the creditors didn't care about me enough to write!
    However, I can duly update the following news:

    Barclaycard C/C
    1/11/10 - Letter received from Calder Financial entitled Formal Demand for Payment (not complied with default notice, will be adding interest, may send debt collectors or commence legal proceedings etc)


    HSBC C/C
    31/10/10 - Letter received from Central Debt Recovery Unit - considering legal action, last chance to pay, enclosing standing order form


    Both are confirmed as unenforceable debts due to crappy documents being received in lieu of actual CCA agreements.

    Niddy, please would you be kind enough to give me your recommendations on reply templates, please?

              Hello Nid. A little Niddy guidance would be gratefully received.

              REF: BARCLAYCARD

              Received a letter from Moorcroft (pre-court division in nice red letters).

              - They will be taking on the debt and charging 1%
              - They want payment arrangements within 7 days (or may send debt collector or instruct solicitors)
              - Barclaycard will not register a default if I start paying (they already have!)

              What is the best letter to send to Moorcroft please, as they are new "owners" of this debt

                      Hello dearest diary, Niddles and all

                      11th January 2010

                      I've received a lovely letter from Clarity, a nice shiny new DCA acting on behalf of HSBC.
                      They are my new account managers - bless! they would like me to either

                      a) pay a nicely reduced settlement figure which gives me a mahooosive 25% discount on the monies owed, or
                      b) ring them forthwith and make arrangements to repay on a regular payment plan

                      If I do neither of the above, they will consider the options available to them, which include
                      "our representative visiting you, or where this agreement remains legally enforceable (I like this line!) recommending to our client that their solicitors be instructed to commence legal action against you."

                      I suppose that I should send the "account sold in default" template, but will await further instruction from Lord Niddles before sending.
