    Hi Everyone and a Happy New Year, letter in from LRC just before Christmas, it has sent out a copy of a Quick Reply Card and the current T&C's and old T&C's with the last page unreadable. The only thing with hubbies signature is Quick Reply Card. What best course of action? Cheers

    Hello Mrs Scarednshakin -- I'm watching your Capquest shenanigans with interest as I'm in a very similar situation with them myself! (ex-Halifax credit card account that they've bought, and Lloyds TSB that they're "administrating" on behalf of the OC).

    For starters I would use the month they have kindly given you. The at the end of that month perhaps you could just tell em that you are not making a new s78 request and that you were merely pointing out that they had failed to properly reply to your previous one so rendering the debt unenforceable.

    Thought I might be getting something in the mail. Had a phone call yesterday and didn't recognise the number. Received a letter from Lloyds telling me that Firstsource Solutions have been instructed to collect the debt.

    Also attached is a letter from Firstsource informing me that they are collecting my delinquent debt and a payment slip. Did notice that the amount they stated is £500 less than previously stated.

    Any info on Firstsource? Googled them but grateful for any other advice/info on them.

    Another letter in today, have not heard anything on this one since January 2013, Firstsource never got in touch. Letter from Lloyds informing me that the account has been assigned to 1st Credit and letter from 1st Credit confirming and asking or payment and if not collection agents will be visiting. Will send out Account Sold letter and see what comes back.

    Sent out missing PT's letter to Capquest and got a response this morning.

    'We have received your request for a copy agreement. Please be advised that this document will only be provided to you if the request is submitted under the terms of the CCA 1974 Sections 77-79.

    Under this act a £1 fee must be provided.

    If you still require a copy of the agreement please sign and submit your request in writing as detailed above with the enclosed £1 fee made payable to Capquest Investments Ltd.

    We can confirm we have placed this account on hold for one month from the date of this letter to enable you to provide the required documentation and fee.'

    Ok completely confused with this one now, according to Capquest they have sent out the agreement and I queried it with the missing PT's template. What do I send out to them now????

    It doesn't matter if you did a s.78 last year or last month. It's clear within the Act (s.78) that you can request a cca every month. So yes send CQ a s.78 and start afresh with them as they won't put up with crap and we don't want two claims being served on you.

    Ignore the offer letter for now. Get a s.78 sent recorded delivery.
    Hi Guys

    Two letters in today from Capquest, the Lloyds Amex account has been put on hold.

    Also received one about Lloyds Acc:-

    Lloyds Online Loan £6,766.56 - defaulted. Lloyds Account No 2

    Last payment made - 24 June 2010
    Passed to Apex - 24 October 2010
    Passed to Moorcroft - 15 May 2011
    Passed to Wescot - 25 November 2011
    Passed to Iqor - 6 March 2012

    Received a letter from Lloyds on 26 July 2013 informing me that they had assigned all of its respective rights etc to Capquest with regard to this account and on the same day received a letter from Capquest informing me that they are now managing the account.

    Sent out Account Sold letter and this account is now on hold while they await documents from their clients.


    opening line is ‘As you will be aware your account is being processed for legal action’ – Was not aware of that!
    They have an offer for us, if we start monthly payment for this account they will credit the account with an amount equal to 30% of our payment.

    Will send out s.78 letter out to them about this one as well.
