    hi all
i have recieved a letter from moorcroft ref my natwest account it says....
i write in response to your recent communication in relation to the above account and can confirm we have been in contact with the royal bank of scotland who have advised us that they have fully complied with your consumer credit act request on 23/08/2010 and sent a further letter to you on the 12/10/10 confirningthey have supplied correct documentation under section 78 of the consumer redit act.
i can also confirm that i have placed this account on hold for 2 weeks and request you make contact with our call centre on the above telephone number to discuss a repayment proposal you can afford and maintain. please be aware that if contact is not made within this timescale our follow up of this account will recommence.
quick recap as below account defaulted and what n-i-d says below
    Hiya Natwest is :UE

Basically there are NO prescribed terms attached, there is also no separate agreement for the PPi (in line with s.18 CCA1974) nor is there any link to cancellation rights. Put simply it is a blass-up of an application that holds no legal weight in court!

If for any reason they went to court and did win *gasp in horror* then i'd be saying reclaim all PPi and charges which would knock 50% + off the debt anyways!

    thanks for your help inadvance

it says... we have been instructed to collect your overdue debt. It is a legal requirement to send a notice of intended litigation before legal procceedings are issued. We believe that this letter fulfils this requirement even if it is not read by you.
to prevent our recommending to our client that solicitors commence legal proceedings it is essential that you settle this debt without delay. it goes on to say contact them before 10/08/2011 and if it goes to court i will have to pay all the costs aswell.
    quick recap
n-i-d says it was a blass up of an application and holds no weight in court also it has been around the block a few times with different dca's should i sent Threat by Lender/D.C.A - To commence litigation
    do you think?
    thanks in adavnce
