    Hi,

    Was approaching it from the ICO guidelines of a default should be issued within 6 months. I've paid nothing for 7 months as well as their policies being inconsistent and not fair to everyone, as I had one after 2 months previously, which was paid.

    In any case, a complaint might actually cause them to issue the default.

    I don't want them to never issue one, as then my credit file is screwed for ever, which is unfair and not an accurate reflection of the account status.

        Totally understand where you are coming from. Hopefully the default will be along soon and then you can start the six year count down.

            two natwest accounts, gone unpaid over a year, both confirmed ue by natwest, still no default, still send min payment statements each month, i will complain, but only once a default has been issued, my complaint will be, the account hasnt been paid for over a year, therefore default is wrong, should be corrected to reflect true default date. until then, no point complaining.

              Hi,

              I'm a bit confused by this approach.

              What if they never issue a default? It will stay on your credit file forever, in my case with late payment markers.

                    They can default within 6 months but remember if it's a current account that is extended to whatever they feel and the FOS tend to side with them too
                    I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website. I am extremely busy so if you do contact me or need a reply to a forum post then use the email or PM features offered because I do miss things and get tied up for days at a time!

                        June 2012 Sent CCA request
                        June 2012 Received CCA with signatures on it.
                        April 2013 Niddy confirmed UE as missing prescribed terms.
                        May 2013 Received a few late payment letters, nothing of interest.
                        Sept 2013 Received a default letter, so hopefully applied to my credit report soon Pushing it a bit, as no payment made since Feb. Will see what date they file the default for before deciding to complain and get it moved earlier.

                        Oct 2013 Received a letter from Debt Management & Recovery Services, Sheffield. We have been instructed by Santander to obtain immediate settlement of the above debt...blah
                        Presumably internal collections as its got Santander marked all over it and its signed by the same bloke who's been signing the other letters relating to the account from Satander...

                          No mate, is two credit cards. Had a massive battle with them to send anything after the signature fiasco, and then finally admitted UE, no docs at all. But have never been defaulted and still receive min payment statements.

                                Sept 2013 Still no default even though not paid a bean or written to them since End Feb 2013. Odd as they have previously issued a default notice after 2 missed payments. No interest has been added for the last 2 months, no idea what they are up to but nothing after the next statement date and I'll send them a complaint to issue the default.
                                Oct 2013 Received a default on my credit file dated May 13.
                                looking back through my paperwork, I did receive a DN in April. Still not convinced its correctly formed, but at this point not fussed as I was hoping for this to get recorded soon.
