        Well, I'll go on record as saying that I think you are completely stark raving mad. They haven't got the agreement, for God's sake. If this was me I'd actually be wanting the scum to take me to court so I could flame their backside and set a precedent for all of the other catalogue fiascos.



        One thing you probably haven't considered - knowing Crapquest and their moral standards, it wouldn't surprise me one bit if they took your "F&F", and then continued harassing you for the rest of the balance.
        The letter is fairly tight, but I get your point.

        Suppose so. They don't have my phone number, well they do, my PAYG that I turn on every now and then, so its all relative as I find letters easy to ignore.

          Thanks for the kick up the backside.

          Will not be paying Crapquest.

          Now do I just ignore them or tell them as they rejected the offer the first time just tell them I've spent the money on something useful?

          I guess the key is not admitting anything as only early in the statute barred timeline.

              Should I be asking Capquest at this point why they have not responded to my CCA request? They cashed my £1 cheque.

              Should I also decline the F&F or just ignore them on that subject?

                General rule of thumb mate is, CCA request and leave it be. No need to ask why they haven't replied but *if* they do get sh1tty with you then there is a template reminding the creditor that they have failed to supply you with it.

                Edit: As for F&F - no contract no money! :niddy

                  Yep, leave this one alone and don't chase them. Wait until they contact you again.

                  Just keep an eye out to make sure they have not credited your £1 as a payment against the account. They wont get away with it, but just keep an eye out.

                    Hi all,

                    Quick update. I updated my post for MBNA account.

                    Just received an email that my statement is ready to view. Not paid since Oct 12, defaulted in Feb, not heard a sausage from them since the DN.

                    When I look online, it says can't display account due to its status, but that the balance is £0 and due payment is £0.

                    How long before they sell it do you think? they just adding some more interest before they sell it?

                      Our account went like this just prior to selling so think you bang on with your reasoning.

                      I read you have PPI on this? Claiming/not claiming? Whats the reason?

                      They are doing something very very strange with PPI refunds.

                        PPI was cancelled when i realised I had it, many years ago.

                        I claimed PPI mis-selling and MBNA rejected it as they bought it from A&L in 2003 I think and say i could have cancelled it then. So as they didn't sell it, not their fault and they have forwarded it to Santander as they would have owned A&L a the time of sale...

                        I do intend on sending to FOS, just waiting til they sell the account so they can't nick anything if I do get a result with FOS. I think theres at least a grand to get back from MBNA from when they took it over.

                        Will also be chasing up with Santander, but not heard a bean seince MBNA say they forwarded my complaint early May.

                        All odd really, as I thought when they took over a business they inherited the job lot including being responsible for this kind of claim.

                          Dont matter what happened after the event.

                          The clue is in the word miss selling. If it were miss keeping it on years after the event because it was bad value and wouldnt pay out cause it was a pile of poo then I would agree with MBNA.

                          But its called miss selling for a reason so MBNA talk crap.

                          Did MBNA when they took over the card from A&L write to you and explicitly say this product is rubbish and you can cancel if you want to but you wrote back and said something along the lines of no actually I like being ripped off and I think you should take lots more.

                          Of course they and you didnt. They kept it on because it was good money for them. You kept it on because you actually trusted the banks back then like we all did.

                          The only bit of truth is that Santander should be firmly in your sights on this as they own what was A&L now.

                          What reasons are you hoping to give for the reason you were miss sold the PPI.
                          Have you started a complaint yet? The reason I am asking is MBNA are trying to timebar some of these difficult complaints by referring all the way back to first contact.

                            Agree with Ken.

                            HSBC used the same excuses, "I had every opportunity to cancel the PPI at the time the loan was active, and it would have been explained at the time"

                            This is of course bollox, the point is, it was missold for those very reasons, it was not explained correctly, the fact you could cancel anytime is also irrelevant.

                            Their answer is just a fob off, because when or if you take it to the FOS it will take 12-14 months before they get round to agreeing with your case. MBNA know this, so do HSBC, which is why they say what they do.

                              MBNA said they wrote when they took over the account and said I could cancel it free of charge, TBH, I didn't know it was on the account and when I did I cancelled it.

                              They said I fitted the criteria, 18-70, working (and alive I bet )

                              I have complained, filling out the standard PPI form. I sent to MBNA and they said its really up to Satander.

                              I'll send it to the FOS and let them figure it out.

                              I guess I should also send an identical complaint to Satander with a copy of the A&L letter?

                              I have a lot of good reasons why it was missold, I included them all on the PPI form the FOS use when I complained to MBNA.

                                I think its a very good idea to carry on.

                                However bit of a glaring missing link here.

                                No final go to FOS letter so the complaint is still live with the creditors. FOS will hoof it back to you without one of these. So would have to wait on Santander anyhows to speak to you or waste 8 weeks. And we only have MBNA's word they did anything to help you. That would be a first a bank doing the decent thing.

                                If I may be so bold and you have a few days spare that you are happy to play with I would start a new thread in the PPI reclaim section and get DI30 involved.

                                This would leave your thread here for advice about UE free from the PPI claim. Stops confusing everyone.

                                Santy aint called Satans bank for no reason.
