Yeah, me too. Another week towards SB
When Gold isn't enough, there is SA Gold! New to the forum and find the UE route a bit scary? Take a look at my diary here and judge for yourself. I am now saving the money each month that was making little difference to the balance and not a bit of difference to my credit file as a result of finding AAD.

No even I'm not that stupid - I cut and pasted it but I did type the address

I'll post next week then, bit cross as they imply I haven't been in contact with them but I did send my CCA request from this address back in January and they acknowledged it! They really are stupid aren't they!

06.09.13 - I have received a letter from Aktiv Kapital which reads as follows:-

You have not responded to previous letters we sent you so we have recently obtained additional confirmation that this is still the correct address for you.

It is important you contact us to arrange repayment of this debt. At this time you can still resolve this matter without the need of further action being taken by us and we urge you to call us immediately.

This balance is still outstanding and is now due for payment.

          Next Step

Our next step may involve passing your account to our field agent, who will contact you to arrange a time when they can call at your home to discuss repayment options with you.

          Alternative option

We will allow you the option to set up a monthly payment arrangement with us directly and benefit from our incentive programme called "New Deal".

Alternatively, you can received a reduction in the amount you owe and potentially pay as little as £6678.96, which will be accepted as full payment.

If you call within 10 days we will make the arrangements for you.

I have never received a response to my CCA request from February, as you will see they did write and say that they were trying to gain the information but my account would be on hold from collection until a time that they had a copy. As far as I am aware they do not have a copy yet. They did write to say that they had sold the account to Aktiv Kapital Assets but this is definitely from Aktiv Kapital.

Do I need to send anything in response to this? I feel I should refer them to my original CCA request that has not been fulfilled but is that the right thing to do and if so is there a template letter? The CCA request was sent on 31.01.13.

I would be really grateful for any advice.

Received a reply today, hmm a little odd I think and I could do with some advice.

19.09.13 - letter received from Aktiv Kapital in response to my final response letter sent as advised a week ago.

          Dear

I refer to recent communication regarding the above account.

This letter serves to acknowledge receipt of your correspondence and to confirm that the matters raised are being reviewed and investigated. We have contacted the original creditor, with a view to obtaining copies of the original documentation pertaining to this account.

Once we receive a response from them, I will contact you again with the same.

In order to assist further with our enquiries, please confirm at which time you left the following address ........... (my address)

I trust the above meets with your requirements and I look forward to hearing from you within 21 days.

          Yours sincerely

The odd bit is the bit about my address - I have not moved from here since I moved in over 6 years ago and it was the address they have had registered since I informed Egg of my move at that time - I did take out the card at a different address.

I am thinking I will not be contacting them about my address; I have never said I have moved from here it just doesn't make any sense. Shall I just wait and see what they send next?

          Thanks in advance.

I wouldn't be confirming anything, they are clearly confused, better to leave them that way

18.10.13 - well I have received a response from Aktiv with papers numbered 1 - 25 from Canada Square Operations which they are claiming to be my CCA - I will scan the main pages and email to Niddy but I am slightly concerned as they have photocopied them back to back and the page 2 is missing - it goes page 1 of 25 then jumps to page 3 of 25 which is just an A4 sheet which contains my signature and date and a signature box signed on behalf of egg. No where does it list my name or address but I suspect that might have been on page 2 which hasn't been copied..... There is then 8 pages of terms which I am assuming are from the point of the application and 14 pages of terms with all the interest rates and figures blanked out.

Not sure what to do now - I will email to Niddy and hopefully he can give me some ideas.

If there's a page missing they ain't complied. And it should have your correct name and address for the time it was issued. Similarly it's not acceptable to blank out interest rates, idiots!!!!!

Thanks Elsa, I did wonder that - they have blanked the interest rates out on the latest t&c's not the ones at inception - but there is nothing at all that shows my name or address. As I say my only concern is their page number jumps from 1 of 25 to 3 of 25 but no where is page 2, I suspect that is the page with the main part of the CCA address etc. I will keep it safe in case things get nasty but page 2 must be sitting in a file somewhere in their offices unless they've lost it fingers crossed.....

                              Hi Jane

We have had a CCA back from Canada Square. Pages numbered 1 to 30

In ours page 2 is indeed the front page of the CCA and as you have surmised it is the page with the name and address of both us and the bank along with the limit, interest and charges and repayments.

Page one is a covering page from Canada Square Operations and page 3 is the signature and date by us and the bank.

Also like yours the T&C's at closure have the interest rates, total cost and name blanked out but in our case you can just about discern what they were. Again no address.

Thanks Ken, wonder where I stand with this - Page 2 is not within their pack - I suppose it makes it EU at the moment but as they obviously have just had a drongo photocopying they would easily rectify it....

Is yours enforceable with the second page?
