      5.11.13 Advised by Niddy to send the Missing PT letter - sent proof of delivery today - will sit and wait to see what happens - they haven't sent the main page of the CCA which I suspect they think they have so it might confuse them Also not received statements either..... As it stands this CCA is but will need looking at again if they do send page 2

        yea see what they come back with..... you'll be fine
        I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website. I am extremely busy so if you do contact me or need a reply to a forum post then use the email or PM features offered because I do miss things and get tied up for days at a time!

          When Gold isn't enough, there is SA Gold! New to the forum and find the UE route a bit scary? Take a look at my diary here and judge for yourself. I am now saving the money each month that was making little difference to the balance and not a bit of difference to my credit file as a result of finding AAD.

            5/12/13 received a letter from AK - the content of your letter dated 04/11/12 has been noted and action has been taken to address your points, we have contacted Egg Banking Plc in order to retrieve the front page of the agreement.

            Your account will continue to remain on hold until we have fulfilled your requirements in regards to consumer credit act 1974.

            I didn't tell them what was missing, they obviously worked it out all by them selves! Do I just ignore this? I suspect I do until the page appears?

                23.12.13 - letter received from Aktiv Kapital - I would appreciate some advice on how to respond

                I moved in 2006 to my current address - should I just tell them? They haven't sent the first page of my agreement that was taken out when at the old address so I am wondering if this has something to do with it - whether they are trying to reconstruct the first page and put the right address in? What would you do, any advice would be much appreciated.

                  the date you left your old address, wouldnt be the date you signed the agreement, so if they tried to use that date, the recon would fail in my opinion, but see what others say.

                      Ah i see what you mean. Better ask an expert, dont want to say the wrong thing and they recon it with the right address

                        sounds like they don't have the little details and want you to help them out, i would ignore as they should be able to get all the info from the account number, if not, ho ho ho merry christmas

                          I agree with NW. I would ignore it...why send them information they should already have?

                            Dear me, next they'll be asking you to confirm what the interest rates were when you took it out. They need that address to fabricate a credible recon.
                            No way would I give them it!
                            I'd ignore again Jane but if they push just say you are unable to comply with their repeated requests for information which, if their claims are valid, their client should already have on record. If they do not hold specific information and documentation on this account then it calls into question the legitimacy of their demands for payment, and you have concerns about supplying them with information to enable them to fabricate that which may not exist.

                            Just my opinion..see what others say

                              If they wanted that information then it shouldn't be hard to get that from either:

                              1) The CRA's

                              2) The original agreement (oops thats where they have a problem isn't it).

                              I'd either ignore, or alternatively you could just have some fun and use the prepaid envelope to send them a blank sheet of paper. This will confuse those lacking in the brain cell department when they open your letter and it'll cost them some postage. Small mischief I know but it'll keep them on their toes!

                              Ultimately if they have the account number this should be enough - don't give them anything that will help them put together a re-con. If they're not certain of your address, and they get this wrong, then it also would throw into doubt any credibility that the t&c's would be accurate too.

                                Sounds like they are trying their best to piece something together Jane. Fingers crossed they give up and you don't hear anything more from them.
