    This is very true. Almost all my creditors were unwilling to help or agree to discuss payment plans until I had either defaulted, or been issues with, a default notice. The focus was very much on cough up the arrears or we will trash your credit file.

    When I told them I didn't give a baboons testicle what they did to my credit file there was lots of spluttering!

    You've been waiting 18 months for them to try and prove the account is enforcable....

    In the meantime it remains in default and firmly

    You poor bugger

    Must be the worst feeling ever Good luck that it stays that way

    Well B/Card CCA's are well past the 14 day stage now

    What nice people they are.... They sent me a nice letter for each account/Request - From different people!

    One was a short to the point Template letter acknowledging my request....

    The second was a longer possibly human generated letter acknowledging my request

    I can just imagine them in the basement now, Dark, Damp and dimly lit.... Rummaging through all the CCA's

    Then if they draw a blank by lunch time..... Off to the Blue Peter office up on level 3 where they keep the scissors

    Just like we used to be, but like i said we got sick of being controlled by the dca and decided enough was enough, you need to be back in control and when you show them that you are , then that is the biggest weapon you have against them , just looked through your diary and yours are looking to be ue so stop worrying your already back in control there , now you just sit back and see what happens and you will be given some great help on here as you have already seen , in a few months you will thiking , how did i let those morons cause me so much stress

    well done!! . Also don't worry about the interest and charges because when/if they come back ue then they won't be getting anything anyway

    If any come back enforceable you will be guided on here on how to blag them so still won't be paying , but lets keep our fingers crossed that they are come back ue

    Think with the £12 fees your only way to get them back now is being able to get them to agree hardship.

    But as you quite rightly say if you aint giving them the information they aint going to just agree that u have your back to the wall.

    But I would of thought most accounts they can spot as they are starting to go wrong. When the customer is in dire straights and struggling. And doubt they need the customer to even tell them.

    But what do they do to help struggling customers. Oh yeah put up the interest rates normally so from just being able to cope they push you over and then probably instead of just one account being a bit iffy so many of us suffer financial meltdown trying to crawl back out of the hole the banks have dug for us.

    Hence why get defaulted. Its going to happen so why put it off. And the positive is nearly all will stop the interest and charges.

    Thanks Deepie

    I have read in previous UE diaries that the general advice was to ignore them regarding I&E requests so I thought that would be the way to go.

    The creditors are still adding interest ect at the moment and have refused to stop... Despite me writing them some "nice" letters (In the past) asking them to stop as a growing balance is counterproductive for all concerned. But in their wisdom they have not stopped.

    I am going to add up all the interest and charges (Overlimit fees/Missed payment fees) since informing them that my circumstances have changed - I bet it would add up to quite a bit on each account by now!

    Is there a way in which I could look at getting them to refund those fees.... Given the circumstances?

    The £12.00 overlimit fee ect is the newer "Fairer" amount but when could it be argued that it is unfair to keep piling on the fees with no end in sight? I suppose if this ever made it to court you could ask for these continued fees to be taken into account so at least the balance would be lower?

    Could they not then argue that you failed to send us a new I &E sheet?

    I shall ignore their letters asking for the I &E then ..... Filed

    If it were me , i would stop the token payments and ignore their request .

    Stopping payments always feels like the wrong thing to do but once you take the step you actually feel more in control and not the creditors controlling you

    Was in the same boat in the autumn and took us a while to get our head round that we have played their game and it got us nowhere, just got them richer.

    Now we dont engage with them except when we have to and seeing as only a court can demand that information we just ignore it now.

    And guess what. The sky didnt fall in. Well it did in Russia yesterday but I doubt even a DCA could fib so much as to say that was them that did that to you.

    Only a court can order you to fill out a I&E form , so if it were me I would ignore thier request.....
