    Ken

Thankyou - You have obviously been researching in the same places I have!

I had seen that regarding assignments too.

I just think that given the lack of information on these - Hardly anything on here, I do have to take on board any small info I can find

As with Lowells/Brian Carter ect - If they seem a bit trigger happy it may be a case of "A stitch in time saves nine" and an early on well constructed letter may put this to bed and passed back to AMEX sooner rather than later - Who knows if Brachers see it as a dead duck - Mabee with a reccomendation that this one is "not going to be worth it"

I seem to remember that not so long ago Scabhunter ( The Legend) drafted a letter for someone who had just been assigned to Lowells and they backed off and returned to original creditor ect - Different circs I know but the theory is the same.

I will be sitting down later to draft a letter to these - Prehaps I will post up the letter as they seem little known on here yet there ars quite a few with AMEX debts.

After all - The master plan is to get past the six year post by all means fair and fowl then turn and wave to the creditor and ride off into the sunset in my by then clapped out trusty steed ( Rusty Ford fiesta)

    Re: Spud's UE Diary

If they are proper solicitors which they seem to be they would also not want to take on a dead duck if there are plenty of holes in it.

The lack of internet noise points to one of two things imo. Either accounts from Amex are few and far between or 2) they do it correctly thus not giving someone much to complain about.

There is seemingly rather alot of excitment on other forums about assignments and if you can or cant use not being told about one in your defence.

Perhaps this is what they are meaning and hence the lack of a titledl LBA. Be quick off the mark if it is one tho.

    Ken

That's what I am thinking (Gut feeling) and although it is not a massive balance, I have not paid since christmas ( Will update all diaries details later) and since then this is the first contact I have had bar a reduction offer a couple of weeks ago. Because I was making payments untill christmas they may see me as a bit of a soft touch and think a bit of pressure will have the desired results ect - It wont !!

Obviously I know if they went for an SD ( I know it may be unlikely and believe me I an NOT worrying about it happening) I could if need be pay off a small amount to bring it under the BR threshold if needed so thats a bonus!

Ive put so much into the UE route.....The plan is to see it through and not get to the SD stage if I can help it!

My gut feeling.....And it is probably overkill I know.....Is to treat these in the same way as people tend to advise with the likes of Lowells ect

Im not one to worry about empty threats ect - Ive ignored plenty in my time and it seems to have worked well but something about the wording in this letter ect and the trigger happy nature of this firm spell out that they may just need a different response

Proactive management - Get a well constructed letter in early to hammer home the points - ( There are quite a few !!!)

They will then see that their hands are prettymuch tied - Its not just an open and shut case and will hopefully pass back to Amex.

Think I would take this as real deal solicitors.

Not an awful lot on the web about them but they do obviously do some work for Amex. But like you said it seems to be a prelude to them starting litigation.

I think dealing with asap at the start could avoid them issuing anything before you really have made any meaningful contact.

That said havnt seen an account as small as yours with them. They all seemed to be whoppers.

    Thanks Mrs D

I was a bit concerned as I had read that Brachers are a little litigation happy, Especially with the old SD's

Its probably standard template letter stuff but I notice that their letter makes reference to the contents of this letter satisfying the pre action protocol blah blah blah although it is not headed as a letter before action ect - Its just been assigned and its to introduce themselves as it were

I'll wait a few days and send off as reccomended - See what they come back with and get my diary entries bang up to date in the between time !!!!!

I thought that would make you all chuckle ...... They even set it all out headed and official looking bless them

They have spent ages on it and worked really hard into the night to get it looking so official

I mean..... Whoever heard of a "Letter of Concern" ..... They are the only ones that seem any way concerned about it

RMA have now sent me a "LETTER OF CONCERN" to explain that they are concerned that I have not contacted them to make a payment arrangement.

I sent them a "Prove it letter" as I do not know of any amount being owed to RMA and it is me who is concerned that they have not replied

I think a one liner is in order....

They set this Letter of Concern out so well, Almost official looking Its just a shame that THEY are the only ones concerned about it
