    3rd December - Arrow still waiting for documentation from the OC, account remains on hold etc.

    22nd Jan - referring to previous correspondence. At this time we are unable to obtain a copy of your CCA from the originating creditor.

    The account will not be subject to collection activity until such time as the document becomes available and we provide you with a copy of the same.

    Drydens have now responded.

    "Please be advised we have contacted our client regarding this matter and we are still awaiting their response. We will inform you of the outcome as soon as this is received"

    Word for word the same old rubbish they come out with every time.

    They know the law. If they didn't, they wouldn't be suspending (attempted) collection activity.

    Drydens letter still not signed for however, Arrow have replied today.

    'We do not accept that we are the creditor as envisaged by the above statute. However, we are willing to assist in obtaining that which has been requested. We will now process your request for documentation from the creditor and will revert in due course.'

    They go on to confirm that all collection activity will be suspended pending provision of the documents. (this sentence being almost identical to a letter from Drydens in Oct 2012)!

    Typically the letter I sent to Drydens (23rd Sept 1st class recorded) is still not showing signed for on Royal Mail site! (it states that it is being progressed through our network for delivery)

    The copies that I sent to Arrow one day later (24th), was signed for on 25th!

    I think it would be wise for you to send a new CCA request to Drydens (they're a proper law firm) because it's four years since you sent a CCA request to the OC. Send a copy to Arrow so neither of them can be in any doubt that they can't get a judgement against you under section 127.

    Same envelope as your LBA response is fine. Just make sure you get proof of posting - preferably Track & Trace proof of delivery.

    Only 1 CCA request was sent to MBNA in March 2010, Rockwells response was to the CPUTR letter sent to them in April 12.


    You can send a CCA request as many times as you like after a 30 day lapse since a previous request.

    Would it not be a good idea to send another one to Drydens as well as the LBA response letter ?

    Should I enclose it or send it separately?

    And maybe copy all that to Arrow so nothing gets lost in translation.

    I really must get up to speed again with the templates, I realised that we'd used this one before to successfully kick ass!

    It's very easy to get complacent after over five years of fighting DCA's and it becomes more difficult to offer advice to others because you simply don't have the knowledge of all the changes that have occurred recently.

    It's done and ready to send, thanks guys

    Bearing in mind that Drydens have already had one two years ago and they acknowledged it and confirmed on hold whilst they await their clients response.
