    That sounds ominous

    Was there a deadline or specific date given for you to respond to what looks like a LBA because they state that their client has issued instructions to the firm to commence legal proceedings?

      if it were me I'd respond to that letter ....

        The first letter from them 2/9 gave 7 days, 'then our client may instruct us to issue legal proceedings' , but their client wants to make every effort to avoid etc..... (We were away until 14/9 so didn't see this until we got back)

        The latest one is dated 12/9 but we didn't get it until Friday 19/9 and gives till 26/9.

        Their client is Arrow and Moorcroft confirmed in May that Arrow would not be taking legal action but still liable for debt. This was the result of sending the no CCA letter enclosing a copy of MBNA's letter stating that they were not able to comply with s78 request.

        I'm having a bit of a panic now!

          Agreed Deepie, but I don't think another no CCA letter will do the trick?

          Bearing in mind that Drydens have already had one two years ago and they acknowledged it and confirmed on hold whilst they await their clients response.

                    I really must get up to speed again with the templates, I realised that we'd used this one before to successfully kick ass!

                    It's very easy to get complacent after over five years of fighting DCA's and it becomes more difficult to offer advice to others because you simply don't have the knowledge of all the changes that have occurred recently.

                      Only 1 CCA request was sent to MBNA in March 2010, Rockwells response was to the CPUTR letter sent to them in April 12.

                        I think it would be wise for you to send a new CCA request to Drydens (they're a proper law firm) because it's four years since you sent a CCA request to the OC. Send a copy to Arrow so neither of them can be in any doubt that they can't get a judgement against you under section 127.

                        Same envelope as your LBA response is fine. Just make sure you get proof of posting - preferably Track & Trace proof of delivery.

                          Typically the letter I sent to Drydens (23rd Sept 1st class recorded) is still not showing signed for on Royal Mail site! (it states that it is being progressed through our network for delivery)

                          The copies that I sent to Arrow one day later (24th), was signed for on 25th!

                                Drydens letter still not signed for however, Arrow have replied today.

                                'We do not accept that we are the creditor as envisaged by the above statute. However, we are willing to assist in obtaining that which has been requested. We will now process your request for documentation from the creditor and will revert in due course.'

                                They go on to confirm that all collection activity will be suspended pending provision of the documents. (this sentence being almost identical to a letter from Drydens in Oct 2012)!
