Moorcroft are a persistant lot!
Had another letter mid April, nothing too concerning as the one paragraph went as follows :- If you do not contact us following receipt of this letter we may have no alternative than to recommend to our clients that they consider possible further debt recovery action against you.
Then another today offering a MONTHLY INSTALMENT OFFER! If we do not respond within 7 days, this may leave us with no option but to recommend to our clients that they consider taking further debt recovery action against you.
Still not very worrying letters but I guess it might be an idea to write and tell them to bog off!
We have written confirmation from MBNA in Oct 2010 that they couldn't comply with the s78 request.
BUT my husband found a letter that we had from Rockwells in June 12 which enclosed a copy of the agreement!
It's a very poor copy and refers to the terms of the agreement which of course were not supplied!
I think it must have been put away at the time because of the MBNA letter and not filed in the folder, it's strange though that other DCA's haven't picked up on this and we're certainly not going to mention it.
I'll try and get it scanned and emailed to Niddy to have a look.
I suppose I could just send a copy of the previous one we sent to Drydens in Oct 12 which states that the s78 wasn't satisfied.
Any thoughts please?

So, six months have passed and they have now put Moorcroft on the case.
They offer a 'flexible approach' to repaying the account and have different options..................................I won't bother anyone with the rest but I guess you can work it out.
Anyway, they will be in contact during the next 7 days by letter and/or telephone in order to discuss .......................
Just to remind anyone subbing, we do have written confirmation from the OC that they can't supply the CCA.

When you get to my age you tend to become ultra cynical. So I wonder whether this letter about "products and services" with Arrow's partners has anything to do with the £400 million float on the London Stock Exchange that Arrow announced last month. Prior to the float they need to beef up their prospectus for the potential investors.

I wouldn't respond to that letter, but I wouldn't throw it away either. Supposing in future they disclose details of your alleged debt to a third party without your permission, then they may have breached the DPA. If they already have your permission to reveal your personal data to their "partners" why would they want/need to give you the opportunity to opt out because they could just go ahead and disclose what they like when they like
Logic says the only reason they're offering you a chance to be excluded is because they know damn well you're not included.
I'd add that letter to your paper trail file.

I wasn't planning to do anything with it, do you think it should be responded to?
Or maybe just wait if anything else happens as it's not threatening in any way and it's taken 12 months to hear from anyone!
