  • At the moment maybe keep quiet. Certainly if they were to send you a letter of claim then send off a CCA request. The object here would be to keep it out of court.

      Letter today offering a 50% discount, which is nice. Filed for now. Tbh, if they offered 75% I'd be very tempted to do it just to tick another one off the list.

        While it is no guarantee, if they are offering big discounts it may be because they think they can not win in court.

        Requesting a CCA is relatively risky- if for example they do not have one but then get one they might just go of it but as you say it might be easier to settle.

        Looking back I can see it was only sold a few months ago- I would hold off in sending a ccc request just yet - some deeds only allow for OC help for a fixed period maybe 6 months maybe a year.

          You haven't sent a CCA S.78 yet!
          As this is pre 2007 this could be difficult for Lowell to say the least!

          Which Company in the Lowell Group was assigned the Account from Nat-West.

            Roger I'm fairly sure it's Lowell Portfolio 1, but will double check my paperwork later.

            Like Pat I am suspicious as to why they are offering such a big discount so soon... can't be a bad thing for me

            I will continue to sit on my hands on this one!

              Just picking out the obvious from your Diary

              The Debt is only £600 and they probably paid pennies in the Pound for the Account thats what £6.00
              The 50% would still give them £300 for an outlay of £6.00 Its Not a Charity they are giving nothing away!
              On a Cost basis to them its not worth their time really is it?

                Jan'24 - CLAIM STRUCK OUT!!!
                JCS strikes again!

                Delighted that this claim has been struck out, almost a year after the claim forms were issued.

                5 of the 7 debts gone now, all thanks to AAD and JCS. Life looking a hell of a lot better as I approach my fourth year of this journey...

                  Not a lot of anything to report for ages, but suddenly a Letter of Claim has dropped through my door.... I guess the downside to blocking phone numbers is you don't know how active the DC's are! LC Asset 2 are the owners, which I have previous with. Hopefully they disappear into the wilderness, but seems unlikely!

                  Will see what comes next, but based on my experience to date, I imagine I'll be getting a claim through in a few weeks. Better gets JCS back on speed dial.

                  • I am fully aware of the debates but have you ever even sent a cca request?

                    personally I would ask for the works especially as this is a relatively low amount but surely even a cca request would help.
                    If they have it you know, if not they may stop.

                      • Hi - No, I haven't ever asked for a CCA. The contact has gone from 0-100 very quickly and never had a need to request it before. Thanks for your suggestion, I will look at this further before doing anything.

                          Yes send a s.78 CCA request with certificate of posting. Would also be good to send a GPDR (Subject Access) request to Tesco.
                          Tesco are in the process of transferring all their loan, credit card and banking portfolios to Barclays Bank in October. This may have triggered the sudden contact.

                        • It’s been a year since the account was sold and with all the work involved with Barclays acquisition of Tesco bank they might not be too bothered about looking for it.

                          As we know, debts are sold with little detail.
                          If they can’t produce the CCA then hopefully they won’t issue a claim so get it posted asap. I have always used Royal Mail signed for but that doesn’t always show up as delivered. Special delivery is of course expensive.
