    Re: Buffy's diary

    Merry Christmas everyone

    Recent update:
At the moment I am still with Payplan, paying £1 to the following creditors

Blair Halifax Credit Cards - Halifax credit card
Moorcroft Group Plc - Homebase store card
    Arrow Global - HSBC loan

I am planning on paying Moorcroft a F+F payment in the next couple of months. Current balance is £400 so I can easily afford it. Halifax credit card is still with the in-house debt collectors, should I stop payments to them to force them to sell it on? How long does that usually take and should I ignore all letters from them unless they send a CCJ? Current balance is £1300 whats the chance they will file for CCJ instead of selling the debt?
My HSBC loan is with Arrow Global, balance £3300, I cant afford a F+F at the moment unless its something like 20%. Has anyone had any dealings with them? Also the loan has not being reported to any credit agency which I find weird. Can they start reporting whenever they feel like it? This is a loan from 5-6 years ago.

      Hi Buffy

      Happy Christmas

I wouldn't be ignoring anything, you need to let us know what they are saying so that we can try to avert any CCJs, however if you're still paying these clowns, it'll never be SB. You have a choice really, stop paying, and go for SB or just keep paying the pounds forever.

I am still paying these 3 creditors £1 a month, all 3 defaulted about 3 years ago and are all enforceable. If I stop paying them now I have another 6 years till they are SB but they can file for CCJ at any time. If they serve me a court order do I have to pay the whole amount within 30 days or will they take a F+F settlement?
Do most people just stop paying until the creditors threaten court action? Is there an estimate of creditors that just haven't bothered and debt became SB or do most apply for a CCJ?
I would like to negotiate a F+F with Arrow Global and Moorcroft. If I stop paying them is it norm that they will first attempt a settlement or will they go straight for CCJ?

IF they went for a CCJ, you can offer to settle. If you paid in full within 28 days of judgement, the CCJ is removed. Theres no clear cut answer to which DCA will go for a CCJ and which wont, but from expierence Moorcorft would likely pass the debt on to someone else.

Got a letter today from Moorcroft accepting £300 F+F on a £405 debt. Have replied back saying that I can only afford £200 (it is after Xmas after all) and if they will consider that.

I would have replied back offering £ 50

Haha I was tempted but I know Moorcroft usually wont settle for less than 70%

Up to you. You have not really fought them on UE yet, even though you know it's UE. I would not have offered the buggars anything. Your choice you have told them that they can go for the jugular!

                      I still wouldn't have offered 50%!

Start at 10% and move up in 10% multiples

A bit late when you've already offered 50%.

If Moorcroft turn your offer down I'd stop paying and let them pass it on to someone else....then you can start your F&F negotiations at 10% as in the link Niddy gave.
