        Re: Squirrelnutkin UE Diary

        Hi Niddy

Re Barclaycard I sent the harrassment letter as advised to Apex on 21st January.

I received another letter from Apex today dated 25th Jan. It reads as follows:

"Home visit agent instructed [in box at top of letter]

We have written to you on numerous occasions and note no contact has been made.
Our previous letter gave you a final opportunity to make payment or your account will be passed to an external doorstep agent who will arrange a visit to your property. Our field agent will now be instructed to arrange a visit at a time that is suitable to them.
Should you wish to arrange payment on your account prior to our agent's visit, it is imperative you call our office without further delay."

Erm...they claim to have written to me on numerous occasions? I have only ever had one letter from them and that was the previous one also threatening home visit!

Now I sent my letter to them on 21st as I said-do I assume this crossed in post?

Re Mint Also today, I received a letter from Fredrickson dated 24th January. It reads:

        LETTER BEFORE ACTION

THIS DEBT MUST BE PAID IN FULL TO THESE OFFICES WITHIN THE NEXT 7 DAYS OTHERWISE WE WILL TAKE IMMEDIATE ACTION

Should it be necessary to issue proceedings in the Count Court (or the Sheriff Court as may be appropriate), further additional costs will be added to the balance outstanding.

If a judgement or Decree remains unsatisfied a bailiff or sheriff officer may be instructed to recover assets to discharge then outstanding debt. Judgement debts are registered by the court. A Judgement debt or Decree against you would seriously affect your ability to obtain credit in the future.

        Payment can be accepted etc"

I wrote to them on 21st Jan with the letter you had suggested in your post of same day.

Again do I assume it has crossed in the post?

You have to presume that the letters have crossed. Have you got proof of delivery yet from online?

            Hi Niddy,

Eek...did not realise I should send everything recorded-sent ALL CCA requests recorded but have been sending most other letter normal 1st class post. Know better now

However, Fredrickson have received my letter re Mint and have replied as follows:

"Thank you for your recent communication.

Our client has instructed us that is you require copy statements or a copy of your agreement detailing how your balance has accrued, or any other data protection request then you will need to write to them direct at the following address:

            Data Protection Requests
            etc

Please note that you will need to send a covering letter specifiacally stating what it is you require and encloses a cheque or postal order for £10.00 made payable to RBS.

Our client will process these request directly.

            Your etc"

£10.00? So what it that all about?

Ignore them, the £10 is the SAR fee..... not relevant to you.

As for the letters - EVERYTHING must go recorded except legal replies which go special. You have no proof of anything so if they go for a ccj they will beat you - point is, prove that you sent that letter on X date? You can't can you?

              Send everything recorded.

Re Capital One: received two letters from Capquest, one dated 1st February stating that they are

"unable to comment on the dispute you have raised as this was prior to our involvement and at the time the account was passed to us we were unaware of any existing query. Therefore we are closing the account on our system."

Then the next day another letter arrived dated 2nd February stating

"We can confirm your account has been placed on hold until 15th Feb 11 whilst we investigate this matter for you."

                      Hmm

                            Hi Niddy,

Sorry have not been on for a few days...youngest son has been unwell so rather distracted.

Re Capital One received another letter from Capquest dated 10th Feb as follows:

"We thank you for your correspondence and respond as follows:

With regard to your dispute, our client states that:

This has been sent to Extrernal Recoveries and Collections for review. You have had the final response posted. There is no valid dispute.

Please make an offer of payment as soon as possible.

                            Yours etc"

With regard to Barclaycard have had no less than 3 letters from Apex dated 9th, 10th and 11th February!

                            The first simply states

"The balance outstanding to our client is shown above." That's it!

                            The second reads:

"Our client has requested we contact you to arrange payment of the full outstanding balance.

We have mad enquiries and sources have shown that you are resident at the address on this letter. Our clients have advised that previous attempts to contact you via other agencies have been unsuccessful and this is potentially your last opportunity to arrange payment before further action will be considered.

Our staff are fully trained to assist you etc...

To prevent this matter becoming unmanageable, please contact our office within 10 days of date of this letter."

And the third...is exactly the same as the second! Still absolutely nothing from Barclaycard in response to CCA request.

Have not been on here for a while as youngest has been so unwell I have been unable to face dealing with the debt stuff.

Have had a couple more letters from Apex re Barclaycard.

The first, dated 20th Feb, states that

"Our client has now formally requested that we commence proceedings to recover the outstanding debt.

You are now at risk of your account being passed to an external field agent who will arrange a visit to your property. To avoid a home visit at a time that may not be convenient to you, you must call our office without delay. There is an opportunity for you to make payment to avoid an agent attending your premises.

To arrange a more suitable time it is imperative you call one of our agents..."

Then another letter arrived from Apex dated 2nd March:

"We have written to you on numerous occasions and note no contact has been made.

Our previous letter gave you a final opportunity to make payment or your account will be passed to am external doorstep agency who will arrange a visit to your property. Our field agent will now be instructed to arrange a visit at a time that is suitable to them.

Should you wish to arrange payment on your account prior to our agent's visit, it is imperative you call our office without further delay"

I think we have been down this road before...and still no response from Barclaycard themselves regarding CCA request!

Regarding Mint I today received a letter dated 17th March from Fredrickson International.

                                It reads

"We regret to note that you have failed to make payments to discharge this account.

Unless we hear from you with proposals for repayment of the debt within 10 days enforcement procedures will be taken without further notice."

I know Niddy is away on a well deserved holiday; does anyone have any advice as to what my response should be? Many thanks!
