    I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website. I am extremely busy so if you do contact me or need a reply to a forum post then use the email or PM features offered because I do miss things and get tied up for days at a time!

      Oh I see charming, ganging up on me now then is it.....LOL ;-)

      PS - I have now received the response off Reigate saying they are asking the OC for an agreement, etc.... this should be fun as I have been doing the very same thing for yonks after dealing with a shed full of lovely DCAs too in the process...all we got was an application form that did not have the pref account number on it..

      Right, back to laying flags in a driveway now...all fun...

                      I think they could issue proceedings, but s78 would probably be part of your defence as under dispute.

                      SD is only where the debt has no clear disputes, which by their nature, most sold debts would have.

                        I had a SD set aside voluntarily by a DCA (for MBNA) when they were faced with the Hammond vs Pro Fit argument (thanks to Paul). They reluctantly accepted that there were "triable issues" with the s.78 response documents which should be dealt with by a county court and not BR. Having withdrawn the SD it was open to them to issue proceedings in the county court but they never did, and that was one year ago this week. Long may that last

                        If anyone wants to enjoy seeing PlanB fall apart under pressure from a SD you can read the thread.It was probably the worst eleven days of my life It's also a prime example of Team Niddy in action
