    It is the usual 'scare tactics' language that is used. They are using 'legalese' to misrepresent the legal position (i.e. Keynes will litigation consideration, but not actually pursue litigation).

    Chances are you will then get letters from them stating that they will 'consider recommending litigation' to their clients.

    I'm afraid you are wrong. If they make a claim, and if it successful, then they can apply for a charging order on your home, effectively securing the debt.

    This is a looong way off yet (if it were to happen), so lets just wait and see what Keynes send you.

              Update on this:- Niddy has been a great help with this, he's advised me to start a diary re this whole situ which I will do but just wanted to ask for a little more advice because of a letter I received today.

              State of play is despite sending a F&F letter twice they have rejected my offer and because in the template it states offering £1 a month in a context that "you don't really want that so accept my offer" they lept on this and decided to settle for £1 a month, they also included an income vs expenditure form and will review this amount in 3 months plus a DD start date of 28/2/14. I've never agreed to this and as I only received the letter today obviously the date has passed by. So my question is what is my next move?

              When I start a diary I will include any advice helpful to the issue here.

                Presumably nobody can help further here ok fair do's but regards to starting a diary where is the best place to do so? As I noticed the diaries all come under UE which I have established is not the case on this one, but the DCA is doing my head in and I need to get something written down.

                      3. Last offer amount
                      4. Maximum offer available
                      5. Have you done a CCA Request

                        1. Just looking up up the last date paid absolutely ages ago hopefully should find it by the time I mail you.
                        2. £3961.50
                        3. £1000
                        4. £1200 poss £1300 max
                        5. CCA done long ago, took an age for them to produce docs but when they did you verified as enforceable.
