It is the usual 'scare tactics' language that is used. They are using 'legalese' to misrepresent the legal position (i.e. Keynes will litigation consideration, but not actually pursue litigation).
Chances are you will then get letters from them stating that they will 'consider recommending litigation' to their clients.
I'm afraid you are wrong. If they make a claim, and if it successful, then they can apply for a charging order on your home, effectively securing the debt.
This is a looong way off yet (if it were to happen), so lets just wait and see what Keynes send you.
