        Mate this is post April 2007 so you cannot utilise UE as the relevant provision was repealed
        I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website. I am extremely busy so if you do contact me or need a reply to a forum post then use the email or PM features offered because I do miss things and get tied up for days at a time!

            Update - As Niddy pointed out that the debt is enforceable but he kindly gave me final option I could try however the DCA came back today with a letter quoting the Carey vs HSBC case where a true copy of the agreement is not required etc etc, anyway point is now if I have to contact them to work out a repayment plan are they likely to play hard ball when it comes to agreeing a monthly repayment figure? as I've had to make them work and used delay tactics.

              Ignore them for now. Sort a payment plan if and when they get heavy.

              Keep us updated but don't do anything yet. Try and save cash to make a F&F offer if and when they get stroppy

                  Update - I'm in a position to make F & F with this, I haven't contacted them yet since the last communication, a couple of questions though, firstly I can offer a third of the debt generally is this a non-starter would they want more? next presumably I use a template letter to do it? and finally as I have couple of established payment plans in place already with some other DCAs do I have to declare this when making the offer?

                  Grateful for any advice

                    I would hold your horses mate. Put the money you have in an account where its not going to get touched. If you can top it up each week, month - great.

                    When (if at all ) they come down heavy then you could look in to a F&F. Generally the longer this is drawn out the better. The more hassle they have/sell it/have to deal with the more likely they are going to sell it off for coppers (in comparison to the original amount) just to get rid of it.

                        Update - Received Final Notice today stating they have now refereed this on to another DCA I think? To commence litigation that will increase the amount etc and to contact to avoid this happening, what would you recommend my next move?

                            As you have not taken up our offer of help, we have no option but for your account to be now referred to Keynes Collections for litigation consideration to resolve this on our behalf.

                            They may commence litigation against you which will increase the amount payable due to costs incurred. Should the matter proceed they could take charge against your property (if you are a homeowner) or have monies deducted directly from your salary (if you are employed).

                            It is not too late to resolve this matter, please contact us immediately to allow us to help you avoid this.

                              Looks like standard bovine excrement to me. Unless Keynes are given correct assignment of the debt (which you should be notified of), they cannot commence legal action against you. The claimant currently should be Barclaycard. Its worded to frighten you.

                              I'd wait and see what Keynes Collections write to you with and take it from there.

                                Without wishing to downplay anything I thought it just a scare tactic, the debt is unsecured so surely they can't attach it my home ( I might be wrong) and I'm self employed so not sure what they can do there either.

                                Yeah I'll wait to see what Keynes Collections say.
