The court refused to rectify a Tomlin order where both parties were under the common mistaken assumption that the claimant bank had a charge in its favour to secure the defendant company's indebtedness. There was no common intention that the bank was to have a separate charge to secure the company's debt because they thought they already had such a charge (Lloyds TSB Bank Plc v Crowborough Properties Ltd).
