    Just to add to this, Creation also wrote in their letter that they would investigate the 'harassment of calls to see if it was excessive!!!

    Creation at one point as noted above called my house phone and mobile every 5 - 10 minutes. They stopped the mobile but despite saying that I was not 'Flossy' or gave them the AAD no or whatever I said they still called. I sent them a letter of harassment and this is when I got the above letter back.

    I have noted every call and time.

    Had a letter off Creation today for the nice sofa I have with stitching undone but at least not collapsed completed like the last one..

    They say that they will knock off all their annual charges (hasnt been a year and had 4) if I pay the amount out right. They waffle on (bit like me) about SCS say I wont let them replace the 3/4 of it that would need re covering as they cant get hold of me and then they say in the same paragraph that SCS says there isnt a fault with the sofa!!!!

    Should I write another letter to ?????Ive run out of people to write to!!!!

    Okay

    They are mental! I haven't said anything to them apart from the 'stop ringing me letter'. It was ages ago I spoke to a bloke on the phone and explained my situation (for the 100000th time )and he said he would give me 48 hours, and he would put the relevant notes on their system. Since then its been nothing but them ringing all the bloody time... If its been on hold so much why have I got over £800 in charges and interest!"!!!! IDIOTS

    I will keep everything together (as they are now anyway) and all new letters I will update straight away and deal with them..

    Ok, let them get another answer from SCS and this time stay on top of things and we will follow it up with all the necessary legal threats and regulatory complaints.

    As they have provided the credit for defective goods, they're in for a shock as they're going to be held ultimately responsible if you do decide to return the goods to their front door

    Hi everyone

    Ok. I have received another letter from Creation today. This letter is now unbelievable... I have complained about the company that sold me the Sofa (SCS) which collapsed, etc and then replaced by one that looks nothing like my first one and not even the same shape, doesn't fit in the room and is presently in the garage as it has all the seams coming away despite not using apart from once or twice as I cant sit on the sofa due to my back, hence why I bought the other one that collapsed!

    You can see the story at the beginning of this thread...

    The letter today says:

    "Dear ****

    I should like to acknowledge receipt of the complaint made by you in relation to the above account.

    The complaints team will now begin investigating the matter. During the course of our investigation it may be necessary to contact the retailer involved; however we will endeavor to have a response to your complaint issued as soon as possible.

    Please find enclosed a leaflet that explains how we handle customer complaints.

    Yours,
    ******"

    I have complained so many times to SCS and to Creation with regard to the above and they have put it on hold for months at a time until they have spoken to SCS. It always comes back as "SCS have tried to contact you for the past 8 weeks (or whatever) and they have been unable to contact you in order to send a upholsterer out to fix your sofa, therefore we have finished our investigationa dn are satified that SCS have done all that they can and that we now require the full amount outstanding, (or sometimes its demand payments of £*** or whatever they feel like at the time!) and would appreciate if you could up date your account details and pay the money that is now due".

    It has been on hold on and off now since I ordered the first sofa. They then started to chase the money for the second sofa which was again faulty, earlier than they should have. After emailng Creation and writing letters to them about the history of the problems, they have put it all on hold. It was supposed to have been on hold until a few weeks ago yet, I am in debt with them in interest and letters of over £800!!!!! ???? Now, once again its on hold despite being called every day by them to the point of it being more than harassment! Some days it was every 5 mins and others was on and off all day between 8am and some times 8pm or later...

    I have written to SCS many times especially to the CEO who obviously just passed to the customer team to ring me ordering me to get the sofa fixed. They wont let me speak to anyone higher up in the company, not even a supervisor!

    I find them all completely incompetent idiots! (that's being nice)

    UPDATE:

    Received a letter from Creation this morning saying:

    Account number **** Agreement number ***

    Outstanding balance **** (£843 over the price of the sofa)!!!
    Arrears £***

    Despite several attempts to contact you, we have not received any payment on the above account.

    You must contact us with a proposal to settle the outstanding balance, please ring ******** . If you fail to do this within the next 7 days, we may forward the account to an External Debt Collection Agency who specialise in doorstep collection and serious arrears accounts of a similar nature to this. Alternatively, if you are a homeowner we may commence proceedings to obtain a charging order against your home/assets.

    Please note - If legal action or a referral to a Debt Collection Agency is necessary, your debt may increase as you will be liable for costs incurred.

    For sending this letter, a fee of £25.00 has been added to your outstanding balance in accordance with out terms and conditions. Please note that information regarding the conduct of your account will be registered with the Credit Reference Agencies, and this may make obtaining future credit more difficult.

    Whilst this is a serious matter, we are here to explore all repayments options with you. If you are experiencing Financial Difficulties, the call us immediately on **********.

    Hi everyone,

    Just a quick up date on Creation / SCS.

    Creation are still calling my house and its gone back to every 5-10 minutes which is very annoying. I dont answer the calls and just let the answer machine deal with it. They never leave any messages. They started using a different number a few times (only 2-3 times) I think to try and catch me out so I will answer.
    I have told them they have the wrong number, I have given them the free 'Niddy' number, I have recently sent the 'harassment by telephone' template.

    I am still getting letters from them at £25 and £30 per letter. I haven't responded to any of them. I am not sure if I am right by ignoring the letters!!!???

    Can only wait and see what happens and if they stop the calls when they have received my letter.

    Any comments, opinions, advice, are welcome....

    Hi,

    Not a lot to update but while I am here.

    They have called the house everyday so far until I gave the other no from Niddy (they call me on an 0800 no). They seemed to disappear for a few days and then started calling the house again, and several times a day. I answered it once to say they had the wrong no and the rest of the time just hung up straight away or left it to go to voice mail.

    Now they seem to have got my mobile no (probably off SCS) and are calling that instead. I have not answered any of the calls. I have had to turn to silent as I cant turn it off due to me carrying everywhere just in case I need help, etc.

    One things for sure is that they dont want to give up! LOL

    I would end the call as soon as you know it's an harassing call, and not leave the phone on the side with it connected as many financial sector companies and DCA's use 0845 and 0870 reverse charging lines.

    Soon as you know what the call is just end it and record date and time.
    Thanks POP. I forgot I had put the phone in mums hat! Shes gone out with it now and the phone!

    I wonder if they were calling to make an appointment to come and see me as they have been ringing me recently and not speaking. I hadn't thought of that pop. Will put it down in future. I haven't done it before, it was just today as I was up all night and mum was in bed and didn't want them to keep ringing.

    You need to chill out for now. SCS etc is one of the last things we'll look at.

    Seriously just record dates and times of the calls etc. we'll deal with this later.
    I am chilled out but I was just reading about them earlier and with the calls and them sending 'postcards' I thought I could maybe deal with that in between waiting for my CCA's and court stuff.

    Also, the longer its left, if I take to court they will ask why I left it so long before starting court proceedings, etc.

    Will send my other CCA I got and read the letter from Cabot received 30 mins ago!

    Update on Creation.

    The calls stopped for a short time and now they are calling the house about twice a day with them not speaking and then the phone goes dead..

    I have received further letters charging me £25 - £30 per letter. Yesterday I received a 'post card' which the post man can read which has:

    CREATION

    As we have not been able to contact you recently, we have arranged for one of our representatives to call at your address.

    This will be between the hours of 8.30om and 8.30pm Monday to Friday, or 10.00am and 2.15pm Saturday.

    If this is inconvenient for you, please call *********

    As I am typing this they have just called me and this time a man finally spoke. My phone is now by the side of me with them still on the phone. I have left it. They are paying for the call not me!

    Right, action is needed now. I am fed up of the letters, charges, calls, etc.. I really need to do a letter to them both. I know I can use Section 1 ? and Section 75 in the letter but, as I have said before I am unsure of what to put and how to make it sound like I know what I am talking about.

    Is there any template's at all connected with the consumer rights in a situation like this? Or something similar? Or can anyone help add the bits in with the correct Sections?

    That's a very good question CC.

    I have letters that are charges as ANNUAL STATEMENTS at £30 per letter and about 5 or so of them. The credit is just a year old now!!!!!! Its been on hold up until now under investigation by Creation .... The rest of the letters are £25 of just being letters!

    I did have a letter saying that I owe just over £800 in interest and letters, etc.... I only owe £1095 for the sofa!

    Its a stupid situation.

    SCS should have taken the 1st sofa away as per their own agreement and left it at that... They wouldn't do that so, I have ended up with a sofa that I cant use, seams coming undone, etc and in the garage! I refuse to pay for a sofa that is faulty, that I didn't choose, doesn't fit in my room, can't sit on due to my back and needs approx. 60-70% re-covering!

    Like I have said I have written to the numpty at SCS and the other numpty at Creation in Ireland and UK and they ignore you or say they will re-cover the sofa and all will be okay!
