Why are Default Notices, issued by Mercers on behalf of BarclarCard deemed invalid ??

If a DN quotes the above section does it only apply to regulated agreements.Or can it apply to any unregulated(exempt) also?

I have a BA Amex card for which there was an annual fee of £30. I could stomach this as the primary purpose of the card was to earn BA airmiles; however I've received a letter today saying the annual fee has increased to a staggering £150! This makes it very much NOT worth continuing...

Today I got my £1 cheque back and a compliments slip saying they were returning this cheque and would send me a seperate letter explaining why they have done...
