My employer has re jigged our commission structure (in their favour of course) and there's a bit in their that I don't think is legal. I sell advertising in case this influences anything.
They've basically said that they will take commission clawback from our salary if there is no commission to be paid.
I seem to remember being told a while ago that commission can only be clawed back from commission payments and not from salary. Is this correct? Is this actually the law? Where can I find this in writing so that I can provide my company with a copy?
