Hiya, arghh - so you're in essence not on any pay whatsoever, see the problem?

How are you surviving...? You must have some money, formally I mean? No benefits is fine, but do you class yourself as self employed or just nothing, ie cash in hand?

Who do you bank with, ie your bank account? Do you have one still?
How would you afford the offer?

I used to be self-employed, ceased the business a few years ago as I went through a bad patch. I am surviving on my savings and doing part-time on babysitting & cleaning to earn extra income. My sister don't charge me for staying at her's and I love her to bits for helping me.

The f&f settlement offer money is coming from my mum, she's trying to help me so that I can get my life back. I will pay her back once my life is back on track.

Yes,I do have a bank account, its a basic account with HSBC.

Ok then you need to reply to the letter explaining what you've told me above - ie that you're not currently working and residing at your sisters until you get back on your feet. You then go on to say that you have no income, and that your parents have offered to lend you money to clear these debts - then explain that you have several debts and therefore offer the amount offered as full and final settlement, refusal will result in nominal £1 per month payments being offered for the forseeable future.

Thats it, don't go on and on about irrelevant stuff, stick to facts and be short and sweet.

Can I ask, is your bank balance healthy or quite empty? if empty, great - then send a full month statement to prove nil income receipted, however its got a few grand in then forget that!

Send CCA and Niddy said he's unsure about this one as it is a flexible loan cum fixed term loan and as such there is no clear limit, yet all loans should contain the relevant prescribed terms - the main one in question is for fixed sum loans (e.g. bank loans, hire purchase agreements) the agreement must contain "A term stating the amount of the credit". In any case, lets presume that it is UE and see what they come back with.

PHEW!!! Have updated my diary.
Don't know how you do it Niddy.......its so confusing and that's only my own diary, lol!!!

Have not send of letter yet,thought I would wait a while, so that they don't think I am desperate to pay them.
Will be sending the letters off sometime next week.......I think!!
