    Well, i said the other day i woke up to some real shitty post....

    Well today, i woke up to an email from Niddy, which made it all better!

    MBNA IS

    The prescribed terms mention clause 9.4 which is MISSING from the agreement and the T's & C's

    Im so happy!

    My MBNA agreement looked kosher to me...but Niddy said it was UE.

    However, there do seem to be a lot of court proceedings being issued on behalf of MBNA at the moment.

    Wait until Niddy's seen the cca

    can we stop getting harassed until Niddy actually looks at decides whether or not it's UE or not, then we'll get a plan. Mr D and I have seen DLC off with a very large slightly UE so hold on until you know what's what. They are very good at threats, but that is about it.

    DLC RE MBNA have actually sent the CCA, took them nearly a year.

    Appears to all be kosher, but will email Niddy anyway.

    If Niddy finds it enforceable i need to decide what to do, as DLC have been quite heavy handed with threats of CCJ's and CO's and i believe they are likely to apply for one even if they agree a monthly repayment.

    So if Niddy confirms enforceable, i wouldnt mind some opinions from you guys about what i should do with this, and the best options ive got.

    Its crazy though, two natwest accounts, one admitted UE and dropped it, the other just keeps going round in circles, no standard procedure with these idiots

    Hey guys, little update

    Natwest have replied to my 2nd no signature letter sent to them. This time they havent returned the PO but have sent a letter saying

    "sorry to see you are unhappy with our service, we have refered the matter to our complaints department and will write to you by 21st November"

    They have also enclosed their complaints procedure leaflet lol

    How hard is it for them to just send the CCA or admit they dont have one, these guys are beyond stupid.

    Remember – The clock is your friend.

    To win the game, they need to take aggressive action at their own expense. That is, issuing a court claim. If they have already admitted that they cannot enforce, they would be incredibly stupid to do that.

    You can win the game simply by doing nothing and allowing the limitation clock to expire.

    Make sure that whatever you do is prompted by your own reasoning, and not by any anger or other emotions which others may have instilled within you. If you allow their anger to prompt your actions, you will have surrendered control of the situation to the enemy.

    It is only the template dalek spewing out more threats it cannot carry out. Situation normal. Nothing to worry about.

    Coupled with a client non stop ringing begging to help him get a mortgage no lender will ever agree, i think today has just done me in. LOL
