Regardless matey if they issue an SD we just get it discontinued.

Im sure Paul would love to see their claim if one indeed arrives. I'm also sure beating them won't be too hard

as for calling work, did they say anything about debt? Or anything that could be construed as embarrassing to you? If so - Ooops!

Long time nom speak all,

Quick update re Lowells and HBOS,

They passed on to their solicitors (in house I think) quicker than the time they allowed me to respond to their original threat of action , so I responded as a complaint via their complaints manager a few weeks ago.
Anyways , today I received a letter saying that they have,as a gesture of goodwill, returned my file to their client.

Result.....so far at least , as this is a biggy to me.

Hi all,
Hope everyone is well and fighting the good fight!

Quick update:

Things have been on the quite side for me for a while (thanks team and hopefully I am not tempting fate) so have been concentrating on issues at work.......frying pan into fire...lol

Anyway,

The only accounts that have been chased recently are my BOS accounts (5) and MBNA accounts (3) which seem to be being dealt with globally and have had the usual replies sold in dispute etc etc. I have also started adding that the dispute has been ongoing since July 2010 and that they (the latest DCA / owner of the debt) has been sold a 'pup' as no one before them has been able to provide a compliant CCA.

Recieved a letter this week from Marlin who I have never heard from before , nor am I sure which account they are on about (as there is no reference on the letter to any of my accounts) BUT , they say that until the requested documents are received 'your credit agreement has become unenforceable , however this does not mean that the debt can be written off'.

Good luck finding the agreement , many have tried over the past 3 1/2 years.

They go on to list thing they can and cant do , one cant being that they cannot get a court judgement against me , but one can is that they can take me to court?
Why would they if they cant find the CCA ,as it would cost them more money?

I assume they will chance their arm at sometime prior to the debt becoming statute barred.

Marlin are wankers mate. They lie to the court, the lot. They have one silly bint running things called Denise McClean who is clueless.

They take people to court, yes, but they lie & cheat daily. Easy to beat due to their lies but they are nasty too. Maybe not so much now they don't use Rectums who are just as bad.
