Paid LTSB when originally requested CCA - does this count?
Letter was sent recorded - c/w postal order & BOS responded to same with copy of an application form which was deemed UE.

Moorcroft have been hassling me over this and they have had the 'sold in dispute' and then 'application form recieved' templates to date...

Recieved a letter from them yesterday saying that there is clearly a difference of opinions between me and their client and that they therefore believe that the best course of action was for them to RETURN MY FILE TO THEIR CLIENT.

Lets see who picks this up next.

              Matty

Letter received from APEX today (must be on their hit list) chasing this account.
Not heard from them before on this one so will send 'em off a 'sold in dispute template' with an added bit of sarcasam at the begining asking them how they expected me to respond to their letter 'within 5 days from the date of this letter' when I only recieved it 6 days sfter the date on the letter.

              Matty

              Update 8-8-12

Letter received from Apex dated 3/8/12 stating that I must respond / make payment within 78hrs - trouble is I didnt get the letter until PM on the 8/8/12.
They say that their client has instructed them to commence proceedings.legal action MAY be taken, legal costs MAY be incurred & my account MAY be passed to a 'recovery specialist' who will visit me at home...etc.

Not sure whether to drop a quick line refering them to my previous letter to which I still await their response and until such time as they do the account remains in dispute .....or.....send 'em the 'threat of lagel action' template.

              Cheers

              Update 20-09-12

A dropped em a quick line in the end (been away for a couple of weeks) saying that I still awaited their response to my previous correspondence and that our letters must have crossed etc etc.

Letter received from APEX saying that as they have not been able to reach an 'accommodation' on this account then they have requested that they recall the account from Apex.

Lets see who comes after me next.

              Happy hunting all.

Cheers Nidster et al for all your help.

                LTSB MCard

Previously deemed UE by the Boss

Evening all - Its been quiet for a while - but this has popped its head up again - this time Moorcroft have picked this up and issued me with a threat of legal action etc etc.
So have bashed off a 'threat of legal action' template in response modifying it slightly to inform them that they are now DCA no 7 to be passed this file by LTSB.

We will see what comes next.

                Cheers,

                Matty

This has been round the houses a bit - now with Moorcroft on behalf of Arrow Global.

In response to my last letter - Application form received - They have sent me a copy of my signed acceptance form saying that they have now answered all my concerns etc etc.

They have put my account on hols for a further 28 days to allow me to respond.

Any ideas what / how I should respond to this or I am stuffed

I would send this mate, no you're not stuffed --> Our Templates | Unenforceability Templates | CCA Query - Creditor Refusal to Accept UE Status

                        Re my MBNA Mastercard account

I have received a letter today saying that they have returned my file to their client - result.

Arrow Global have finally responded to a letter I sent to Rockwells when they were chasing this account back in early June.

They say that they have satisfied my CCA request and enlcosed more copies of the same crap I have previously been sent - a signed copy of an acceptance form going back to 1997.
All previously inspected by his Nidship & deemed UE.

They also state that they are not interested in any ongoing PPI / default sum charges claims as they were not a party to my purchasing such cover and that I should refer my query back to MBNA .......who no longer own the account nor did they respond to my letters re the PPI claim settlement - IE I did not accept it as full and final settlement.

Its a complicated one this one .... as I had 3 account with MBNA 2 had PPI (not this one) and I believe the amounts outstanding re the PPI claims are more than the total outstanding balance on the 3 cards....so not sure what to respond with.

They finish their letter saying that the debt remains and is due in full and that if I am not happy I should refer my complaint to the FOS.

                        Any ideas?

I was thinking refusal to accept UE for now?

It will probably wind them up more..... I can save the PPI angle for when / if it ends up in court.

Matt email me their letter please mate and ill sort a response for you.

Can you clarify do this shower of shyte own all 3 accounts or just this? Similarly have you started the reclaim process with MBNA? If not do so. Do it ASAP on all 3 accounts and treat it as 3 reclaims mate. So you'll do one SAR using all 3 account numbers - so they don't miss one, then work out 3 x reclaims and let me know the amounts owed on each with your estimated reclaim value of each. It helps any argument.

They're talking shit about them being part to the ppi. They own the account so they now take ownership of ALL past and future stuff other than the reclaims themselves

                              Cheers

Will do - I am just leaving for work so will do later if ok?

I agree with what you say re they own it 'warts n all'.

They own 2 of the 3 accounts so far - the third one being an old A&L visa card which MBNA bought at some point many moons ago.
No one seems to be chasing the A&L account.
