    Spent2much had a horror story with them. They managed to get a charge on the house by being extremely deceitful and dishonest. Of course, that was in the pre-AAD days.

    They do use a lot of deceit in their letters, and always claim to be able to do things which are not legally possible. Every time I've had to deal with them on behalf of an AAD member, they've backed down when confronted with the truth. I'm not saying that is guaranteed to happen in your case, but they do have the aura of a bully which looks for easy targets.

        Hey Matt. Don't forget the AAD protocol: no opening mail on the weekends. In a nutshell, f**k 'um!

          Arrow have now written advising that my account has been passed on to Drydensfairfax solicitors.
          A bit worrying to be honest , last time a solicitor got passed my account ,proceedings followed pdq.

          Wait until you get a letter from Drydensfairfax solicitors and post up exactly (word for word) what it says so we can guide you as to your next step/response/reply should be.

          Ignore any/all horror stories of other people's past experiences with the firm.

          The FCA took over regulation of creditors from April which has been proved to be a game changer. The FCA is tough unlike the OFT.

          Try to relax if you can.

          Has this account/credit agreement been deemed to be or at some point? Sorry I should have read back though your thread which I will do soon.

            No need to read back - it was deemed UE by his Nidship back in late 2010.
            Not paid since July 2010 - account opened in 87.

            All they / their agents have been able to provide on the numerous occasions that they have been asked , is the same old 'acceptance' slip which is signed and has my name and address on , along with some generic terms and conditions and copies of statements.
            They seem now to be relying on the signed acceptance slip.

            Letter received from Dyrdensfairfax on Saturday dated 9-10-14 , giving me 7 days to contact them otherwise proceedings will be commenced.


            Contents of letter:

            Dear Matty,

            We refer to the above matter where we are instructed by Arrow Global Guernsey ltd. As previously mentioned , your account was assigned to our client from MBNA and the outstanding balance is due and owing.

            You have failed to repay the amount outstanding on your account or agree to payment terms with our client. This is despite numerous attempts to engage you through previous agents.

            Our client is keen to agree with you how you will repay the outstanding balance in an affordable and sustainable way. To assist in helping to resolve this issues our client has reduced your balance from the original balance to the outstanding balance as set out above to give you the opportunity to settle this account without having to take further action against you.

            Please contact us immediatley on 0113 823 3307 to discuss the position and repayment proposals. We will also seek to call you on the telephone numbers provided by our client.Our intention is to reach an agreement with you to avoid the necessary court action.

            Our client may be prepared to accept less than the full balance outstanding in settlement , in return for an early payment.

            We will work with you to review your financial position and agree an affordable payment plan.

            Should we not hear from you within the next 7 days then our client may instruct us to issue legal proceeding against you, which could result in a CCJ being entered against you.

            Our client wants to make every effort to avoid this and we look forward to hearing from you to agree how the outstanding balance will be repaid.

            They mention in the letter that they have reduced the balance - lol , by £91.52 , to take the balance just below £3K..... seems a strange move and the cynic in me says there is a reason for this ?

            Any help / advice would be appreciated as ever.

              I'm sure I've "seen off" Drydens Fairfax somewhere along the line though, like PlanB says, you can't go off what's happened to someone else as each case is different.

              In that letter they say their client may instruct them to start legal proceedings, not that they will.

                  Drydens issued proceedings against me - again for Arrow, and again for an MBNA account!!

                  Saw them off - or more correctly Andrew did when they agreed to a Tomlin order as they were unable to produce documents.

                  Didn't stop Arrow trying to pass it to another set of Debt Collectors WHILE the court case was going on.

                    Why agree to a Tomlin if they were unable to produce documents? I'm sure there must have been very good reasons, just curious..

                        Ahh well ..... Seems as though I have got a fight on.
                        letter received from Drydens today dated 20/10 reminding me that the have their clients authority to issue proceedings against me and that they will do so if they do not hear from me by the 3/11.
                        no mention of my letter sent to them last week......
                        I will send them another , enclosing my last letter and advising that they must have crossed in the post , although they will have had it before the end of last week . I will send this one SD.

                                I agree with Pixie. Send a new CCA request followed by the LBA response template like Niddy suggested on Clueless24's thread
