    just wondering....might my complaining to FOS be admiting debt & thus affect SB - almost 50% there.LOL.

      I have today recieved a letter from Keynes collections

      NOTICE OF INTENDED LEGAL ACTION

      Obviously part of the same crew a s they are operating out of the same address.
      Have sent the previous lt a CPTUR letter to which I have recieved , to date, no response.


      Do I send threat of legal action with non response to CPUTR ?

        Answer their letter of claim.

        Dont template it really would be my advice.

        A letter of claim which is improperly set out (which most DCAs letter are) can lead them to adverse costs orders against them if you do things right. or it can lead to cock all if you do it wrong.

        The letter of claim is the ideal point to get documents off them. They have a duty when threating legal aciton to provide disclosure of key dpcuments then intend to rely on. So, id hit them hard.

          Further to the above post, I would recommend reading this post by Paul which gives you a basic outline for this type of letter -

          and the posts around it.

          I've composed quite a few responses to letters of claim using this outline, and they have all achieved the desired result. Be careful to proofread it first, though, as there are quite a few spelling and grammar errors in there.

          If you need any help with composing a letter, or you just want someone to read through something you've written yourself, I'll be back online this afternoon.

                Bit of advice please:

                LTSB - Visa : Not paid since July 2010 & deemed UE by his Nidship.

                It has done the rounds with various DCA's and is now with Mackenzie Hall.

                They have had the usual templates and I have recieved a copy of the original application form to which I responded with the application form recieved template.

                They have responded with a further copy of the same application form which they have highlighted the wording credit agreement , which they claim meets my request for a copy of the CCA.
                The document they enclosed is also a poor copy and could be classed as illegible I believe.

                My question is what is the best template to respond with:

                A further copy of the application form recieved / refer them to my last letter confirming this?
                The illegible copy template?
                Or
                Enough is enough template?

                        Re : MBNA V (x2) & M card all deemed UE

                        Ahh well my battle with MBNA, now Arrow Global rumbles on.
                        Arrow are chasing me re my MBNA Visa account.
                        Have gone through the usual templates which have been ignored so have now hit 'em with PPI.
                        Both main accounts are subject to upheld PPI claims.....but the redress offered so far is incorrect and is not in accordance with FOS guidelines - as previously advised.
                        Have told em so today, that the shortfall with the redress is far in excess of the alleged amount outstanding on the account and that they need to correct this including all associated default sums and interest (both contract rate compounded & simple rate where applicable).
                        Will see what this brings.

                          And so it goes on......

                          This time with a Natwest Business OD.

                          Not paid for an age .....2 years or so , and slowly the balance is increasing due to increasing interest charges.

                          The account goes back to the 90's and I have done em for mis-sold ppi and default charges so far, but have not operated the account as a business account for 4 years or more.

                          They are now chasing me down to clear the overdraft as it is up for renewal in July...but they are not going to renew it and say they will charge me unauthorised OD rates on the balance (£3K ish)

                          I have offered to pay em £300 a month but they wont accept this and want me to take a loan out (LOL) - no way.

                          So question is do I fight em and try for UE ( can you do this on business overdrafts ? ) or try for FF?

                          Slight ( well major ) issue is that another business I am involved with is reliant on a Natwest facility - 40 jobs at stake with this one.

                          It seems I am not linked / they dont check properly as this facility has recentley been reviewed and renewed....


                          Dilema with which I could do with some advice please.

                          I guess the snsible thing would be to pay the OD off without a fight in this instance.

                          This however goes against the grain after being shafted by thme personally on so many fronts over the past few years.

                            Hi Matty. This is way beyond my knowledge. I can't understand them turning down £300 a month because it would only take 10 months to repay (not counting any interest they might add on.)

                              Hi Matty,
                              My personal opinion if I was in the same position would be just bite the bullet and settle it, you are going to play a major gamble otherwise if they do eventually link you to the other business connection, and regardless of them just renewing the facility they can and will call it in at the drop of a hat....
                              If you are gambling with other folks jobs then you have to decide if you're own grievance with Nat West is appropriate in this case.

                                Agreed Alland , this is what my heart(and head) is telling me, despite my being shafted by them on a number of occassions.
                                I have saved the jobs (including mine) once as the owner wanted to pull the plug and call it a day so I took it on,however I wasnt told the full facts at the time and the end now might be nigh now anyway despite our best efforts.

                                £3k odd isnt worth the risk / gamble as you say.
