Do I need to go to the trouble?

I was thinking of writing back and asking them to ask Arrow to contact the OC (MBNA) who are more than aware of the dispute which has been ongoing since July 2010.

I would just be referring them to your previous letter, you've told them there is a dispute, so they need to read your letter. I would probably do a one liner reminding them of my letter

        Hi All

        Quick update

lloyds TSB V & M card accounts - Both deemed UE and both not paid since July 2010.
Both have also done the rounds with various DCA's.

Anyway I have recieved a letter for each account on llyods letterhead but with the DCA's address in the top right hand corner.

The letter SEEMS to be just a statement of the account detailing outstanding balance etc.

As there is no demand for payment or request for me to contact them I will ignore and file for now.

Maybe it is just a statement or maybe they are lining me up ........who knows, time will tell.

Keep up the good fight all !

        Matty

Letter received from Coop - Not heard fromn em in ages , account has done the DCA rounds etc.

They have sold account to Lowell - Letter from Lowell in same envelope introducing themselves and asking me to pay the outstanding balance.

Guess its time to start over and pop a 'sold in dispute' template.

Not dealt with this lot before.......

          Will keep you posted.

I think Co-Op might have sold a job lot. Mine is UE (20+ yrs ago so no paperwork) and I'd heard nowt for ages but suddenly it's been sold off to Lowells... who are ringing me every day (and I never pick up the phone).
          Niddified and proud!

Fought and won the UE battle, thanks to Niddy and this forum...

Barclaycard Accounts (2no) - going back to the 80's

Not paid since 2010 and deemed UE by the Boss.

Not heard anything much on these accounts until recentley when they have been passed on to MKDP.

They have had the 'sold in dispute' & then 'T&C's received letters over the past couple of months.

They have now come back with another copy of the T&C's and a covering letter quoting HSBC v Carey back at me and sub section 2.19 of the 'credit consumer act'....saying that this overlooks the fact section 127(3) does not apply merely because a signed document is not available at the court hearing;the section requires that a document containing the prescribed terms 'was' signed by the creditor or hirer.

They finish by saying I remain liable and have 6 months to go to the FOS if I dont agree.

They have not produced anything with my signature on to date , no signed application form , no signed credit agreement.

            Whats the next step please?

            'Refusal to accept UE' letter?

            Thanks

            Matty

                                Well done Matty,

I have my old Co-op visa account sitting with Lowells right now, just had a third letter informing me that the Co-op are still searching their archives for my CCA...and they won't write to me again until such time as they are in a position to send me the CCA.

Hopefully I will receive a similar result as yours in due course, and although optimistic, I will remain cautious as no two accounts are totally the same.
