        I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website. I am extremely busy so if you do contact me or need a reply to a forum post then use the email or PM features offered because I do miss things and get tied up for days at a time!

              Hi - Happy New Year to all.

              Letter received from Howard Cohen in response to my letter (Threat of legal action) saying that they were unaware of any request that I have made for a copy of my CCA and have asked for thier clients instructions.....and that once received they will revert back accordingly.

              Will let you know what they come back with - Cant see 'em rolling over for this kind of value.
              (They are DCA number 4 though which gives me some hope as if there is a case why didnt DCA no1 stick me in court - or no's 2 / 3...or did I just get lucky so far?)

                Hi Matty,

                Happy New Year.

                Just a quick comment. We are have gone through 16DCAs with friends Barclaycard. A Dca working only as an agent for or on equitable assignment only for a creditor cannot bring an action in court against a debtor of their own volition. They only have cause of action in conjunction with the original creditor or the current OWNER of the debt. In our case two accounts have now actually been sold to another bunch of lowlifes, who specialise in lemons, so that may bring a different set of ground rules. Being as no legally substantive paperwork has been forthcoming for the last two and half years I would suggest that the OC was unwilling to try their hand in a court of law and just tried to bring us to heel.

                Lets hope yours all fall into the same basket.

                    BOS Master card - deemed UE / not paid since June 2010 (£6K+ balance)

                    Moorcroft have popped up as the latest DCA to pick up this crock of S**t - threatening me with legal action etc etc etc .
                    Have sent of the 'threat of legal action ' template & will see what this brings.

                    They have numerous of my various accounts on their books and each one has been sent back after a bit of letter (template) tennis.......Time will tell with this one

                      M&S - Enforceable - Balance £6K odd - last paid June 2010.

                      Response finally received from Gothia (Headed - Final Response)on my revised offer and complaint (Lol).
                      They have investigated blah blah and have done nothing wrong etc etc.

                      There client is willing to accept £3.3K in full and final settlement which represents half of the amount outstanding.
                      (They do however mention in their letter that they acted in good faith when they purchased my account)

                      I have swung the lead on this one for more than 18 months and maybe its time to settle??

                      Your thoughts on this would be much appreciated Niddy.

                        Too high mate. I'd Reject the offer.

                        Did it have ppi btw?

                        I would still say £2k is quite a lot. However £3.3 is way too much.

                          Agree with Niddy - like that guy in the film "Used Cars" said - "That price is just too f***ing high"

                          On a side note, (and Niddy is privvy to more info on it all than I) something must be holding them back - I cant see why they would let it drag on this long if it was fully enforceable - no ppi or charges on top etc etc.

                          Maybe I am seeing more than there is, but summat doesnt quite ring true to me.

                              Thanks Oscar - No PPI but there are plenty of charges......I too really dont know why they have not banged this into court as yet?

                                what did they send you by way of agreement, i.e. was it a signed copy? (sorry can't remember)...
