After recent revived interest from Halifax / Blair & Co claiming that CCA they sent last July is enforceable, even though it was a copy of my application form accompanied by T&C's (deemed UE by Nidy)
I have now heard back from WESCOTT re one of my BOS accounts, further to my claim that the account is in dispute again saying that there is no dispute & the account is enforceable as BOS sent all required info after my original request last July.
Again all they sent was a copy of my application form accompanied by T&C's (deemed UE by Niddy at that time)

I will bang em off a copy of what I replied to BOS with at the time (application form received template) and re-affirm that the account is still in dispute and will remain so until I receive the information requested.

    Update 15-06-2011

Halifax are having none of it.

They have written back to me ,saying that they have provided all that they have to and that they dont agrre that there is a dispute, that the account is enforceable etc etc.
    Stalemete.
Do I ignore for now or send of the enough is enough template?

All advice / pointers greatly received.

Also 2 letters recieved from Moorcroft - 1st informing me that Halifax have instructed them to collect the debt and that I should take this as 'notice of intended litigation.
As this is the first I have heard from this lot re this account - I will send off the 'sold in dispute ' template.

What I dont get is why Halifax have dropped in house Blair Oliver Scott and passed on to external agency - If they were so sure they could take me to court and win - why not do it via Blair & Co?

2nd re M&S Account - 1st time I have heard from them - so will start the process over with a 'sold in dispute ' template.

    Cheers mi'dears,

    Matty

Ah Moorcroft, muppets. I think they just dive in with all sorts of woolly threats. I had them with CoOp (I think) but they eventually went away. Just got them with NatWest and I've just done an Account Sold so we'll see what comes next.... They are right pain in the derriere. Good luck!
Hopefully the fact that Halifax didn't use BOS means something...
      Niddified and proud!

Fought and won the UE battle, thanks to Niddy and this forum...

        Update 11-06-11
Received a yellow 'warning' card from AIC Ltd re one of my MBNA accounts, advising me that I should send payment to them immeadiately.
        errrm....NO.
I will ignore for now as it doesnt threaten anything ,also due to the fact that 2 of my 3 MBNA accounts are subject to PPI claims which would be used in my defence / counter claim if they commence proceedings.
Indeed they owe you, so you have a safeguard by holding there money.

Because they're not so sure they can take you to court.

Like MGS says, it's probably all woolly threats

            Thanks MGS ,Pompey & Pixie.

Yet another letter from the Halifax yesterday attaching a further copy of the original application form (signed) along with 2 sets of T&C's(historic & current).
They also say that 'if I would like to arrange payment of the outstanding amount ,please contact their recovery agent.

Gonna ignore this letter & bang off a 'sold in dispute' to Moorcroft.

Received a letter from Robinson Way re one of my LTSB accounts yesterday - usual 'pay up or else' letter.
This is the first time I have heard from this lot about any of my accounts but have read plenty about them on other peoples threads.

Anyway.....this is the 5th different DCA acting for them,so I will start the same process again and send the the 'sold in dispute' template.

Letter received from IQOR re one of my BOS accounts and in response to 'sold in dispute template'.
They enclose a copy of the original signed application form and a number of statements.

They also say I should contact BOS directly if they have not answered all my questions and that they will place the account on hold for 2 weeks.

I will give it a few more days then send off the application form received template.

                        Cheers,

Yes clearly a lot of thought gone into building of the site. That feature is very handy for me as I only have the full use of one hand.

Indeed I am finding the site very disability friendly and that is a big plus.
